The following good practices aim to provide guidance to Territorial States for governing the supply of military and security services by PMSCs and their personnel on their territory.

- Each State party shall take such legislative, administrative and other measures as may be necessary to ensure that PMSCs and their personnel are held accountable for violations of applicable national or international law.
- تحرص كل دولة طرف على اتخاذ التدابير التشريعية والإدارية وغيرها من التدابير الضرورية لضمان خضوع تلك الشركات وأفرادها للمساءلة عن انتهاكات القانون الواجب التطبيق على الصعيد الوطني أو الدولي.

Territorial States should evaluate whether their domestic legal framework is adequate to ensure that the conduct of PMSCs and their personnel is in conformity with relevant national law, international humanitarian law and human rights law or whether it needs to establish further arrangements to regulate the activities of PMSCs.

To this end they have the obligation, in specific circumstances, to take appropriate measures to prevent, investigate and provide effective remedies for relevant misconduct of PMSCs and their personnel.

To provide for non-criminal accountability mechanisms for improper or unlawful conduct of PMSCs and their personnel, including:

1. Each State party shall take such legislative, judicial, administrative and other measures as may be necessary to ensure that PMSCs and their personnel carry out their activities exclusively under the respective licences and authorizations.
1- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية وغيرها لضمان عدم قيام الشركات العسكرية والأمنية الخاصة وموظفيها بأنشطتهم إلا بموجب الرخص والتصاريح ذات الصلة.

2. Each State party shall ensure that PMSCs and their personnel apply due diligence to ensure that their activities do not contribute directly or indirectly to violations of human rights and international humanitarian law.
2- تكفل كل دولة الطرف أن تبذل الشركات العسكرية والأمنية الخاصة وموظفوها العناية الواجبة لكيلا تسهم أنشطتهم بشكل مباشر أو غير مباشر في انتهاك القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي.

The following good practices aim to provide guidance to Home States for governing the supply of military and security services by PMSCs and their personnel abroad ( " export " ).
تهدف الممارسات السليمة التالية إلى توفير التوجيه لدول المنشأ في تنظيم الخدمات العسكرية والأمنية التي تقدمها في الخارج الشركات العسكرية والأمنية الخاصة وموظفوها ( " التصدير " ).

1. Each State party shall ensure that PMSCs and their personnel under no circumstances carry out activities that undermine the sovereignty of another State, its territorial integrity and/or that contravene the principle of sovereign equality and obligation of non-intervention in the domestic affairs of other States and the principle of self-determination of peoples.
1- تكفل كل دولة طرف ألا تنفذ الشركات العسكرية والأمنية الخاصة وموظفوها تحت أي ظرف من الظروف أنشطة من شأنها أن تقوض سيادة دولة أخرى وسلامتها الإقليمية و/أو تخالف مبدأ المساواة في السيادة والتزام عدم التدخل في الشؤون الداخلية للدول الأخرى ومبدأ حرية الشعوب في تقرير مصيرها.

1. Each State party shall take such legislative, judicial, administrative and other measures as may be required to ensure that PMSCs and their personnel import and export their services only under the appropriate licences and authorizations.
1- تتخذ كل دولة طرف ما قد يلزم من التدابير التشريعية والقضائية والإدارية وغيرها لضمان ألا تقوم الشركات العسكرية والأمنية الخاصة وموظفوها باستيراد وتصدير خدماتهم إلا بموجب الرخص والتصاريح المناسبة.

- Each State party shall establish a comprehensive domestic regime of regulation and oversight over the activities in its territory of PMSCs and their personnel including all foreign personnel, in order to prohibit and investigate illegal activities as defined by the convention as well as by relevant national laws.
- تقوم كل دولة طرف بإنشاء نظام محلي شامل للتنظيم والرقابة على الأنشطة التي تقوم بها على أراضيها الشركات العسكرية والأمنية الخاصة وموظفوها بمن فيهم جميع الموظفين الأجانب، وذلك من أجل منع أية أنشطة غير قانونية كما عرفتها الاتفاقية والقوانين الوطنية ذات الصلة، والتحقيق فيها؛

- Each State party shall ensure that the activities of PMSCs and their personnel do not cause or exacerbate inter- or intra-State warfare or conflict.
- تكفل كل دولة طرف ألا تتسبب أنشطة هذه الشركات وأفرادها في تفاقم أو تأجيج الحرب أو النزاعات بين الدول أو داخلها؛

otherwise requiring PMSCs, or their clients, to provide reparation to those harmed by the misconduct of PMSCs and their personnel.
أو (ب) مطالبة الشركات العسكرية والأمنية الخاصة، أو عملائها، بتعويض المتضررين من سوء السلوك الصادر عن الشركات وموظفيها.

(a) Ensure that any State which is not party to the present Convention is informed about the issuance of licences to PMSCs and their personnel to export military and/or security services to this State;
(أ) ضمان إعلام أي دولة ليست طرفاً في هذه الاتفاقية بإصدار رخص لشركات عسكرية وأمنية خاصة ولموظفيها بهدف تصدير خدمات عسكرية و/أو أمنية إليها؛
