3 - بصرف النظر عما تنص عليه الفقرة 2 من هذه المادة يجوز، في إجراءات الإعسار التي تبدأ في دولة غير الدولة التي يقع فيها مقر المحيل، وبصرف النظر عما تنص عليه الفقرة 1 من هذه المادة، إعطاء الأولوية لأي حق تفضيلي يَنشأ، إعمالا للقانون، بمقتضى قانون دولة المحكمة وتُعطى له الأولوية على حقوق محال إليه في إجراءات الإعسار التي تُنظم بمقتضى قانون تلك الدولة.
