It encompasses a positive duty on States to ensure that persons are protected from any acts that would impair the enjoyment of their rights, including by taking effective measures or exercising due diligence to prevent any harm caused by private persons or entities.
ويتضمن واجبا إيجابيا على الدول بكفالة حماية الأشخاص من أي أفعال يكون من شأنها الانتقاص من تمتعهم بحقوقهم، وذلك بسبل تشمل اتخاذ تدابير فعلية أو بذل العناية الواجبة لمنع أي ضرر يتسبب فيه أشخاص عاديون أو كيانات غير عامة.

Moreover, in view of the increasing trend in some States towards the Government greatly reducing its responsibilities in the housing sector, States Parties must ensure that legislative and other measures are adequate to prevent and, if appropriate, punish forced evictions carried out, without appropriate safeguards, by private persons or bodies.

" 20. Also urges all States to promote and adopt effective measures to enforce their immigration laws and border controls only by means of duly authorized and trained government officials and to prevent private persons or groups from carrying out conduct reserved for such government officials, as well as to prosecute and punish those violations of the law that may result from such conduct;
' ' 20 - تحث أيضا جميع الدول على تعزيز واعتماد تدابير فعالة لإنفاذ قوانينها المتعلقة بالهجرة والرقابة على الحدود وعلى أن يكون ذلك حصرا على أيدي موظفين حكوميين مخولين ومدربين حسب الأصول، وعلى منع خواص الأفراد أو الجماعات من القيام بتصرفات لا يحق لغير هؤلاء الموظفين الحكوميين القيام بها، فضلاً عن المقاضاة وتوقيع العقوبات في حالة ارتكاب انتهاكات للقانون قد تنتج عن هذه التصرفات؛

There may be circumstances in which a failure to ensure Covenant rights as required by article 2 would give rise to violations by States parties of those rights, as a result of States parties' permitting or failing to take appropriate measures or to exercise due diligence to prevent, punish, investigate or redress the harm caused by such acts by private persons or entities.
وقد توجد ظروف يسفر فيها عدم ضمان حقوق العهد على نحو ما تقتضيه المادة 2 عن انتهاكات لتلك الحقوق من قِبَل الدول الأطراف، نتيجة لسماح الدول الأطراف لأفراد أو كيانات بارتكاب أفعال من هذا القبيل أو نتيجة لعدم اتخاذها تدابير مناسبة أو عدم بذلها ما يتوجب من مساع لمنع ارتكاب تلك الأفعال أو للمعاقبة عليها أو التحقيق فيها أو جبر الضرر الناجم عنها.

It is also implicit in article 7 that States parties have to take positive measures to ensure that private persons or entities do not inflict torture or cruel, inhuman or degrading treatment or punishment on others within their power.
كما أن المادة 7 تعني ضمناً أنه يتعين على الدول الأطراف أن تتخذ تدابير إيجابية من أجل ضمان ألا يقوم الخواص من الأفراد أو الكيانات بممارسة التعذيب أو غيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة على غيرهم ممن يخضعون لسلطتهم.

It further recalls that States parties have a positive obligation to ensure the protection of individuals against violations of Covenant rights, which may be committed not only by its agents, but also by private persons or entities.

(b) The extent to which States have met the obligation to protect women from any act by private persons or entities which would impair women's rights to equality and to the exercise and fulfilment of human rights and fundamental freedoms.
(ب) مدى ما أوفت به الدول من التزام بحماية المرأة من أي فعل يقوم به أفراد عاديون أو كيانات خاصة من شأنه أن يعيق حق المرأة في المساواة بين الجنسين وممارسة وإعمال حقوق الإنسان والحريات الرئيسية.

1. 1- يدين بشدّة جميع أعمال العنف ضد النساء والفتيات سواء تلك التي ترتكبها الدولة أو أشخاص عاديون أو جهات فاعلة من غير الدول، ويدعو إلى منع جميع أشكال العنف الجنساني والقضاء عليها داخل الأسرة، وفي المجتمع عموماً، وحيثما كانت الدولة هي التي ترتكبه أو تتغاضى عنه؛

The obligation also requires States parties to ensure that persons are protected from any acts by private persons or entities that would impair the enjoyment of the freedoms of opinion and expression to the extent that these Covenant rights are amenable to application between private persons or entities.
ويتطلب هذا الالتزام أيضاً من الدول الأطراف أن تضمن حماية الأشخاص من أية أعمال يقوم بها أفراد بصفتهم الشخصية أو أي كيانات خاصة وتؤدي إلى إعاقة التمتع بحرية الرأي وحرية التعبير بقدر ما تكون هذه الحقوق الواردة في العهد قابلة للتطبيق بين الخواص من الأفراد أو الكيانات().

" 20. وقد يكون ثمة ظروف يسفر فيها عدم ضمان حقوق العهد على نحو ما تقتضيه المادة 2 عن انتهاكات لتلك الحقوق من قِبَل الدول الأطراف، نتيجة لسماح الدول الأطراف لأفراد أو كيانات بارتكاب أفعال من هذا القبيل أو نتيجة لعدم اتخاذها تدابير مناسبة أو عدم بذلها ما يتوجب من مساع لمنع ارتكاب تلك الأفعال أو للمعاقبة عليها أو التحقيق فيها أو جبر الضرر الناجم عنها.

It is also implicit in article 7 that States Parties have to take positive measures to ensure that private persons or entities do not inflict torture or cruel, inhuman or degrading treatment or punishment on others within their power.
كما أن من المفهوم ضمناً في المادة 7 أن على الدول الأطراف أن تتخذ تدابير إيجابية لضمان عدم قيام أفراد أو كيانات بتعذيب غيرهم ممن يخضعون لسلطتهم أو معاملتهم معاملة قاسية أو لا إنسانية أو مهينة.

Any person or group of persons within the meaning of paragraph 1 above should have the right to challenge in administrative or judicial proceedings the legality of any act or omission by private persons or public authorities that contravenes domestic laws or regulations relating to damage caused by activities dangerous to the environment.
2 - ينبغي أن يكون لأي شخص أو مجموعة أشخاص في إطار الفقرة 1 أعلاه الحق في الطعن من خلال دعوى إدارية أو قضائية على مشروعية أي تصرف أو إغفال تصرف من جانب أشخاص خاصين أو سلطات عامة إذا كان ذلك ينتهك القوانين أو اللوائح الوطنية المتصلة بالضرر الناشئ عن أنشطة خطرة على البيئة.

The Committee encourages the State party to introduce specific legislation against racial discrimination by private persons or organizations currently taking place in several of the Overseas Territories, such as Anguilla, the British Virgin Islands, Gibraltar, Montserrat, and the Turks and Caicos Islands.
366- وتشجع اللجنة الدولة الطرف على الأخذ بتشريعات محددة تحظر ممارسة التمييز العنصري من جانب الأشخاص الخاصين أو المنظمات التي تتخذ من أقاليم عديدة فيما وراء البحار مقراً لها في الوقت الراهن مثل أنجويلا وجزر فيرجن البريطانية وجبل طارق ومونسيرات وجزر تركس وكايكوس.
