Although it made significant progress, the Conference of the Parties did not reach agreement and therefore decided to consider further the procedures and institutional mechanisms on non-compliance at its third meeting in October 2006.

50. At its first meeting, the Conference of the Parties decided to convene an open-ended ad hoc working group to consider procedures and institutional mechanisms on noncompliance under article 17 of the Convention.

The secretariat was requested to present to the ahd hoc working group a compilation of those views and to draft a text on procedures and institutional mechanisms on non-compliance under article 17 of the Convention, reflecting the views expressed and the practice of other Mmultilateral Eenvironmental Aagreements.

The Conference decided to consider further the procedures and institutional mechanisms on non-compliance at its third meeting in October 2006.

At that meeting, the Conference prepared the draft text of the procedures and mechanisms on compliance with the Rotterdam Convention. In addition, the it decided to consider further at its fourth meeting in 2008 the procedures and institutional mechanisms on non-compliance required under article 17 of the Convention, taking the draft text as the basis for its work.

The Conference of the Parties may wish to consider for possible adoption the procedures and institutional mechanisms on non-compliance required under Article 17 of the Stockholm Convention based on the draft text set out in the annex to the present note.

Non-compliance At its second meeting, in decision RC.2/3 on non-compliance, the Conference of the Parties decided to consider further at its third meeting the procedures and institutional mechanisms on noncompliance required under article 17 of the Convention.

In its decision SC-3/20 on non-compliance, the Conference of the Parties decided to negotiate further and to consider for adoption at its fourth meeting the procedures and institutional mechanisms on non-compliance required under Article 17 of the Convention.
5 - وقرر مؤتمر الأطراف، في مقرره اتفاقية استكهولم - 3/20 المتعلق بعدم الامتثال، مواصلة التفاوض والنظر في أن يعتمد، في اجتماعه الرابع، الإجراءات والآليات المؤسسية بشأن عدم الامتثال، التي اقتضتها المادة 17 من الاتفاقية.

At its fifth meeting, at the proposal of the President, the Conference of the Parties agreed to appoint Mr. Barry Reville (Australia) as facilitator to identify a way forward at that meeting on the adoption of procedures and institutional mechanisms on non-compliance.

51. The Conference of the Parties at its fourth meeting, held in May 2009, further considered the procedures and institutional mechanisms on non-compliance required under article 17 of the Convention.
