Whereas paragraph (1) refers to a restriction on the ground of nationality, paragraph (2) is open-ended as regards the nature of the grounds that may be found in the procurement regulations or other provisions of law of the enacting State.
وبينما تشير الفقرة (1) إلى تقييد بسبب الجنسية، فإنَّ المادة (2) لا تضع حدودا لطبيعة الأسباب التي قد توجد في لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة.

(a) Any criteria that the procurement regulations or other provisions of law of this State authorize or require to be taken into account;
(أ) أيَّ معايير يكون أخذها في الاعتبار مأذوناً به أو مشترطاً في لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة؛

1. Suppliers or contractors shall be permitted to participate in procurement proceedings without regard to nationality, except where the procuring entity decides to limit participation in procurement proceedings on the basis of nationality on grounds specified in the procurement regulations or other provisions of law of this State.
1- يُسمح للموَرِّدين أو المقاولين بالمشاركة في إجراءات الاشتراء بصرف النظر عن جنسياتهم، باستثناء الحالات التي تقرّر فيها الجهةُ المشترية أن تحدّ من المشاركة في إجراءات الاشتراء على أساس الجنسية، لأسباب محدَّدة في لوائح الاشتراء أو في أحكام أخرى من قانون هذه الدولة.

These requirements and measures would be authorized by the procurement regulations or other provisions of law of the enacting States only in procurement involving classified information and only with respect to that type of information, not any other information that the procuring entity may choose to protect at its own discretion.
وهذه الاشتراطات والتدابير لا تأذن بها لوائح الاشتراء أو غيرها من الأحكام القانونية لدى الدول المشترعة سوى في الاشتراء الذي ينطوي على معلومات سرّية وفيما يخص حصراً ذلك النوع من المعلومات وليس أيّ معلومات أخرى قد تختار الجهة المشترية حمايتها وفق صلاحيتها التقديرية.

1. The procurement regulations or other provisions of law of the enacting State must set out the exceptional conditions under which the procuring entity may limit the participation of certain categories of suppliers or contractors in procurement proceedings.
1- يجب أن تبين لوائح الاشتراء أو أحكام أخرى من قانون الدولة المشترعة الأحوال الاستثنائية التي يجوز فيها للدولة المشترعة أن تحدّ من مشاركة فئات معينة من المورِّدين أو المقاولين في إجراءات الاشتراء.

" Procurement in which the procuring entity may be authorized by the procurement regulations or by other provisions of law of this State to take measures and impose requirements for the protection of classified information. "
" الاشتراء الذي يجوز فيه، بمقتضى لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة، أن يُؤذَن للجهة المشترية بأن تتخذ تدابير وتفرض اشتراطات من أجل حماية المعلومات السرية. "

" Environmental, social, economic and other policies of this State authorized or required by the procurement regulations or other provisions of law of this State to be taken into account by the procuring entity in the procurement proceedings. "

As stated in section II.B above, the authority granted to procuring entities to take special measures and impose special requirements for the protection of classified information applies only to the extent permitted by the procurement regulations or by other provisions of law of the enacting State;
وكما ذُكر في القسم الثاني-باء أعلاه، لا ينطبق الإذن الممنوح إلى الجهات المشترية باتخاذ تدابير خاصة وفرض اشتراطات خاصة من أجل حماية المعلومات السرّية سوى بالقدر الذي تسمح به لوائح الاشتراء أو أحكام أخرى في قانون الدولة المشترعة؛

8. The procurement regulations should therefore guide the procuring entity in selecting the maximum duration of a particular framework agreement within the maximum established in the procurement regulations or alternatively they may themselves establish different maximums for different types of procurement.
8- ومن ثمّ، ينبغي للوائح الاشتراء أن توجِّه الجهة المشترية في اختيار أقصى مدة لأي اتفاق إطار محدد ضمن المدة القصوى المحددة في لوائح الاشتراء أو تحدد بدلا من ذلك هي نفسها مددا قصوى مختلفة من أجل أنواع الاشتراء المختلفة.

(l) " Procurement involving classified information " means procurement in which the procuring entity may be authorized by the procurement regulations or by other provisions of law of this State to take measures and impose requirements for the protection of classified information;
(ﻫ) " الاشتراء المنطوي على معلومات سريّة " يعني الاشتراءَ الذي يجوز فيه، بمقتضى لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة، أن يُؤذن للجهة المشترية بأن تتخذ تدابير وتفرض اشتراطات من أجل حماية المعلومات السريّة؛

For these reasons, these criteria should be treated as exceptional, as recognized by the requirement that their application be subject to a distinct requirement -- that they must be authorized or required for application under the procurement regulations or other provisions of law of the enacting State.
ولهذه الأسباب، يجب أن تُعامل تلك المعايير باعتبارها استثنائية، كما يتبيّن من شرط إخضاع تطبيقها لاشتراط منفصل - يجب التخويل بها أو طلبها من أجل التطبيق بموجب لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة.

(a) Any criteria that the procurement regulations or other provisions of law of this State authorize or require to be taken into account;
(أ) أيَّ معايير يكون أخذها في الاعتبار مأذوناً به أو مشترطاً في لوائح الاشتراء التنظيمية أو غيرها من الأحكام في قانون هذه الدولة؛

2. Both paragraphs (1) and (2) stipulate that the grounds for restricting the participation of suppliers and contractors in procurement proceedings are limited to those found in procurement regulations or other provisions of law of the enacting State.
2- وتنصّ الفقرتان (1) و(2) كلتاهما على أنَّ أسباب تقييد مشاركة المورِّدين والمقاولين في إجراءات الاشتراء تقتصر على تلك الواردة في لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية السارية في الدولة المشترعة.

5. When any of the grounds in the procurement regulations or other provisions of law is invoked by the procuring entity as a justification for restricting participation in procurement proceedings, paragraph (3) requires the procuring entity to make declaration to such effect at the outset of the procurement proceedings.
5- وعندما تتذرّع الجهة المشترية بأيٍّ من الأسباب الواردة في لوائح الاشتراء التنظيمية أو الأحكام القانونية الأخرى كمسوّغ لتقييد المشاركة في إجراءات الاشتراء، فإنَّ الفقرة (3) تقتضي أن تصدر الجهة المشترية إعلانا بذلك في بداية إجراءات الاشتراء.

Foreign suppliers would generally not have any obligation to pay taxes or social security contributions in the enacting State; article 8 prohibits the procuring entity from imposing requirements other than those permitted in the procurement regulations or other provisions of law of the enacting State that would have the effect of deterring participation in the procurement proceedings by foreign suppliers or contractors.
والمورِّدون الأجانب لا يقع عليهم عموما أيُّ التزام بدفع ضرائب أو مساهمات ضمان اجتماعي في الدولة المشترعة؛ وتحظر المادة 8 على الجهة المشترية فرض اشتراطات، عدا تلك التي تسمح بها لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة، من شأنها أن تثني المورِّدين أو المقاولين عن المشاركة في إجراءات الاشتراء.
