(1) This article applies to the ascertainment by the procuring entity of the qualifications of suppliers or contractors at any stage of the procurement proceedings.

The 1994 reference to " reputation " , on the other hand, has been deleted to eliminate subjectivity in the process of ascertainment by the procuring entity of the qualifications of suppliers or contractors.
ومن ناحية أخرى، حُذفت الإشارة إلى " السمعة " الموجودة في نصّ عام 1994 لإزالة الاعتبارات الذاتية في عملية تأكُّد الجهة المشترية من مؤهّلات المورِّدين أو المقاولين.

11. Paragraph (4) requires all criteria and requirements as regards assessment of qualifications of suppliers or contractors to be set out in any pre-qualification or preselection document and in the solicitation documents.
11- وتشترط الفقرة (4) أن تُبيَّن جميع المعايير والاشتراطات فيما يخصّ تقييم مؤهّلات المورِّدين أو المقاولين في أيِّ وثيقة من وثائق التأهيل الأولي أو الاختيار الأولي وفي وثائق الالتماس.

(1) (a) This article applies to the ascertainment by the procuring entity of the qualifications of suppliers or contractors at any stage of the procurement proceedings.

(1) (a) This article applies to the ascertainment by the procuring entity of the qualifications of suppliers or contractors at any stage of the procurement proceedings;
)١( )أ( تسري هذه المادة على تحقق الجهة المشترية من أهلية الموردين أو المقاولين في أي مرحلة من مراحل اجراءات الاشتراء.

2. They should also specify appropriate documentary evidence or other information that may be requested by the procuring entity for ascertainment of qualifications of suppliers or contractors (see paragraph (3) of the article and the relevant commentary [**hyperlinks**]).
2- كما ينبغي أن تحدد الأدلة المستندية الملائمة أو المعلومات الأخرى التي تطلبها الجهة المشترية من أجل التحقق من مؤهلات المورِّدين أو المقاولين (انظر الفقرة (3) من هذه المادة والتعليق ذا الصلة [**وصلتان تشعُّبيتان**]).

(e) The criteria and procedures to be used for ascertaining the qualifications of suppliers or contractors and any documentary evidence or other information that must be presented by suppliers or contractors to demonstrate their qualifications in conformity with article 9 of this Law;
(ﻫ) المعاييرَ والإجراءات التي تُستخدم للتأكد من مؤهلات المورِّدين أو المقاولين وأيَّ أدلة مستندية أو معلومات أخرى يجب أن يقدمها المورِّدون أو المقاولون لإثبات مؤهلاتهم وفقاً للمادة 9 من هذا القانون؛

A procuring entity shall impose no criterion, requirement or procedure with respect to the qualifications of suppliers or contractors other than those provided for in this article.
ولا تفرض الجهة المشترية أي معيار أو شرط أو اجراء يتعلق بأهلية الموردين أو المقاولين بخلاف ما نصت عليه هذه المادة.

The Secretariat was requested to reconsider the paragraph in the light of the distinct issues it addressed, such as assessment of qualifications of suppliers or contractors and evaluation of tenders.
وطُلب إلى الأمانة أن تعيد النظر في الفقرة في ضوء المسائل المحدّدة التي تتناولها، مثل تقييم مؤهلات المورّدين أو المقاولين وتقييم العطاءات.

Since the general rule is that qualifications of suppliers or contractors may be ascertained by the procuring entity at any stage of the procurement proceedings, article 9(1) the 2011 Model Law avoids linking ascertainment of qualifications to any particular stage of the proceedings.
وبما أن القاعدة العامة هي إمكانية تأكُّد الجهة المشترية من مؤهّلات المورِّدين أو المقاولين في أيِّ مرحلة من إجراءات الاشتراء، فإنَّ المادة 9(1) من القانون النموذجي لعام 2011 تتفادى ربط التأكد من المؤهلات بأيِّ مرحلة بعينها من الإجراءات.

14. The purpose of paragraph (8)(d) is to provide for reconfirmation, at a later stage of the procurement proceedings, such as at the time of examination of submissions, of the qualifications of suppliers or contractors that have been pre-qualified.
14- والغرض من الفقرة (8) (د) هو النصّ على معاودة التأكيد، في مرحلة لاحقة من إجراءات الاشتراء، وقت فحص العطاءات مثلا، على مؤهّلات المورِّدين أو المقاولين الذين اجتازوا التأهيل الأولي.

(5) The procuring entity shall evaluate the qualifications of suppliers or contractors in accordance with the qualification criteria and procedures set out in the pre-qualification or preselection documents, if any, and in the solicitation documents.
(5) تقيِّم الجهة المشترية مؤهّلات المورِّدين أو المقاولين وفقا لمعايير وإجراءات التأهيل المبيَّنة في وثائق التأهيل الأوّلي أو وثائق الاختيار الأوّلي، إن وجدت، وفي وثائق الالتماس.

(b) The criteria and procedures, in conformity with the provisions of article 9 of this Law, that will be applied in the ascertainment of the qualifications of suppliers or contractors and in any further demonstration of qualifications pursuant to paragraph 5 of article 43 of this Law;
(ب) المعاييرَ والإجراءات التي تُطبَّق، وفقاً لأحكام المادة 9 من هذا القانون، في التأكّد من مؤهّلات المورِّدين أو المقاولين وفي أيِّ إثبات إضافي بشأن تلك المؤهلات بمقتضى الفقرة 5 من المادة 43 من هذا القانون؛

1. The purposes of the article are: to set out an exhaustive list of criteria that the procuring entity may use in the assessment of qualifications of suppliers or contractors at any stage of the procurement proceedings (paragraph (2)); to regulate other requirements and procedures that it may impose for this assessment (paragraphs (3) to (7)); and to list the grounds for disqualification (paragraph (8)).
1- تتمثّل مقاصد هذه المادة فيما يلي: وضع قائمة شاملة بالمعايير التي يجوز للجهة المشترية استخدامها في تقييم مؤهّلات المورِّدين أو المقاولين في أيِّ مرحلة من مراحل إجراءات الاشتراء (الفقرة (2))؛ وتنظيم سائر الاشتراطات والإجراءات التي قد تفرضها لأغراض ذلك التقييم (الفقرات من (3) إلى (7))؛ وإدراج أسباب إسقاط الأهلية (الفقرة (8)).

(b) The criteria and procedures, in conformity with the provisions of article 6, relative to the evaluation of the qualifications of suppliers or contractors and relative to the further demonstration of qualifications pursuant to article 34 (6);

(d) The criteria and procedures to be used for ascertaining the qualifications of suppliers or contractors and any documentary evidence or other information that must be presented by suppliers or contractors to demonstrate their qualifications, in conformity with article 9 of this Law;
(د) المعاييرَ والإجراءات التي تُستخدَم للتأكّد من مؤهلات المورِّدين أو المقاولين وأيَّ أدلة مستندية أو معلومات أخرى يجب أن يقدّمها المورِّدون أو المقاولون لإثبات مؤهلاتهم، وفقاً للمادة 9 من هذا القانون؛

The procurement regulations should therefore explain the use of these criteria as minimum standards in ascertainment of qualifications of suppliers or contractors under article 9 of the Model Law [**hyperlink**] and the use of these criteria under for example articles 11 and 49 [**hyperlinks**] that would lead to the assessment by the procuring entity of these criteria on a competitive basis.
ولذلك ينبغي للوائح الاشتراء أن تشرح استخدام هذه المعايير كمعايير دنيا في التحقق من مؤهلات المورِّدين أو المقاولين بمقتضى المادة 9 من القانون النموذجي [**وصلة تشعُّبية**] واستخدام هذه المعايير بمقتضى المادتين 11 و49 [**وصلتان تشعُّبيتان**] مما يفضي إلى تقييم هذه المعايير من جانب الجهة المشترية على أساس تنافسي.

the qualifications of suppliers or contractors are assessed, and their submissions are examined against the relevant description to assess responsiveness (see paragraphs (5) and (6) of the article), by comparison with initial submissions in closed framework agreements, there is no evaluation of indicative submissions (i.e. no competitive comparison of submissions, such as is provided for in article 42).
يضاف إلى ذلك أنه في حين أنَّ مؤهلات المورّدين أو المقاولين تُقيَّم وعروضهم تُدرس استنادا إلى الوصف ذي الصلة لتقدير مدى الاستجابة (انظر الفقرتين (5) و(6) من هذه المادة)، فبالمقارنة بالعروض الأولية في الاتفاقات الإطارية المغلقة، لا يوجد أيُّ تقييم للعروض الاستدلالية (أي لا توجد مقارنة تنافسية بين العروض، على غرار ما تنص عليه المادة 42).
