334. The Committee is very concerned that the granting of citizenship to children born in the State party is restricted on the basis of colour or racial origin by the provisions contained in article 27 of the Constitution and the Alien and the Nationalization Law, which are contrary to article 2 of the Convention on the Rights of the Child.

The Committee regrets that, despite its previous recommendation, the granting of citizenship to children born in the State party remains restricted on the basis of colour or racial origin according to the provisions contained in article 27 of the Constitution and the Alien and the Nationalization Law, which are contrary to article 2 of the Convention.
41- تعرب اللجنة عن أسفها لأنه، رغم توصيتها السابقة، لا يزال منح الجنسية للأطفال المولودين في الدولة الطرف يجري حصراً على أساس لون البشرة أو الأصل العرقي وفقاً للأحكام الواردة في المادة 27 من الدستور وقانون الأجانب والجنسية، التي تتنافى والمادة 2 من الاتفاقية.

7.1 The Committee notes that the authors claim violations of article 26 in conjunction with article 2 of the Covenant, insofar as the Anti-Racism Law 927/79 is said to be inadequate for the purpose of protecting individuals against discrimination and because in this case the courts application of the law failed to protect the first and second authors from discrimination based on racial origin.

The Committee reiterates its previous recommendation (CRC/C/15/Add.236, para 33, 2004) and calls upon the State party to take urgent measures to amend its Constitution and citizenship laws to eliminate discrimination on the basis of colour or racial origin.
42- تكرر اللجنة توصيتها السابقة (CRC/C/15/Add.236، الفقرة 33، عام 2004) وتناشد الدولة الطرف بأن تتخذ تدابير عاجلة لتعديل دستورها وقوانينها المتعلقة بالجنسية للقضاء على التمييز على أساس لون البشرة أو الأصل العرقي.

As stated in article 7.3 of this Organic Act, " Personal data referring to racial origin, health and sexuality may be collected, processed and disclosed only when so provided for by legislation, on grounds of general interest or if the person concerned gives his or her express consent " .
