This long-standing issue has been considered previously by the Council of the International Telecommunication Union (ITU), at plenipotentiary and world radiocommunication conferences, and continues to be permanently on the agenda of the Radio Regulations Board.

Transmissions from aircraft are a violation of regulation 42.4 of the International Telecommunication Union (ITU) Radio Regulations, which prohibits the operation of a broadcasting service by an aircraft station at sea and over the sea.
ويشكل البث من الطائرات انتهاكا للفقرة الفرعية 4 من المادة 42 من أنظمة الاتصالات اللاسلكية للاتحاد الدولي للاتصالات، التي تحظر تشغيل محطة للبث الإذاعي محمولة على طائرة تعمل في البحر أو فوق البحر.

The World Radiocommunication Conference, which met in Geneva in 2007, adopted conclusions that found transmissions from aircraft from the United States to Cuba to be in violation of the Radio Regulations.
واعتمد المؤتمر العالمي للاتصالات اللاسلكية، الذي انعقد في جنيف عام 2007، استنتاجات خلصت إلى أنّ عمليات البث الموجهة من طائرات في الولايات المتحدة باتجاه كوبا تنتهك أنظمة الاتصالات اللاسلكية.

This extension is part of a national United States plan that could be adopted worldwide by making this new allocation part of the International Telecommunication Union (ITU) Radio Regulations at the World Radiocommunication Conference 2015 (WRC-15).
وهذا التمديد جزء من خطة وطنية أمريكية يُمكن اعتمادها على الصعيد العالمي عن طريق جعل هذا التخصيص الجديد جزءاً من لوائح الراديو الصادرة عن الاتحاد الدولي للاتصالات خلال المؤتمر العالمي للاتصالات الراديوية 2015.

2. International Telecommunication Union Radio Regulations
2- لوائح الراديو للاتحاد الدولي للاتصالات

The ITU Radio Regulations, as a leading instrument in the international radio regulatory set-up, are based on the use of two main concepts:
إنَّ لوائح الراديو الصادرة عن الاتحاد الدولي للاتصالات، باعتبارها صكاً رئيسياً في هيكل تنظيم الاتصالات الراديوية على المستوى الدولي، تستند إلى مفهومين رئيسيين وهما:

Under the ITU Radio Regulations, frequency assignments of satellite networks can be filed on behalf of a group of Administrations; one of those Administrations acts as the notifying Administration in the interests of the whole group.
وبمقتضى لوائح الراديو للاتحاد الدولي للاتصالات، يمكن التقدم بطلبات تخصيص ترددات للشبكات الساتلية باسم مجموعة من الإدارات؛ وفي هذه الحالة تضطلع إحدى الإدارات بدور الإدارة المبلِّغة لصالح المجموعة ككل.

Textually, the Conference stated in its conclusions on the case: " a broadcasting station operating on board an aircraft and transmitting solely to the territory of another administration without its agreement cannot be considered in conformity with the Radio Regulations " .
وجاء في نص نتائج المؤتمر بهذا الشأن: ' ' أنه لا يمكن اعتبار قيام محطة إذاعية من على متن طائرة بالبث في اتجاه إقليم إدارة أخرى دون موافقتها عملا يتفق مع لوائح الراديو``.

The main challenge is to find technical solutions in accordance with the provisions of the ITU Radio Regulations without the use of technologies that have export restrictions to Cuba.
ويتمثل التحدي الرئيسي في إيجاد حلول تقنية وفقاً لأحكام أنظمة الاتصالات اللاسلكية الصادرة عن الاتحاد الدولي للاتصالات دون استخدام التكنولوجيات الخاضعة لضوابط التصدير إلى كوبا.

- Article 42.4 of the ITU Radio Regulations, prohibiting the operation of a broadcasting service by an aircraft station at sea and over the sea.
:: الفقرة الفرعية 4 من المادة 42 من أنظمة الاتصالات اللاسلكية للاتحاد، التي تحظر على المحطات المنشأة على متن طائرات تعمل في البحر أو فوق البحر توفير أي خدمات للبث الإذاعي.

- Article 23.3 of the ITU Radio Regulations, limiting television broadcasting outside national frontiers.
:: الفقرة الفرعية 3 من المادة 23 من أنظمة الاتصالات اللاسلكية للاتحاد، التي تقيّد الإرسال التلفزيوني خارج الحدود الوطنية.

At its fifty-third meeting, in March 2010, the Radio Regulations Board of ITU had urged the United States Government to put a stop to that interference.
لقد حث مجلس أنظمة الاتصالات اللاسلكية التابع للاتحاد الدولي للاتصالات السلكية واللاسلكية في جلسته الثالثة والخمسين في آذار/مارس 2010 حكومةَ الولايات المتحدة على إيقاف ذلك التشويش.

- Article 8.3 of the ITU Radio Regulations establishing that internationally recognized frequencies assigned and recorded must be taken into account by other administrations when making their own assignments in order to avoid harmful interference.

The conclusions endorsed by the plenary stated that " a broadcasting station operating on board an aircraft and transmitting solely to the territory of another administration without its agreement cannot be considered in conformity with the Radio Regulations " .
وجاء في نص الاستنتاجات المعتمدة في الجلسة العامة بأنه ' ' لا يمكن اعتبار قيام محطة إذاعية تعمل على متن طائرة بالبث حصرا باتجاه إقليم إدارة أخرى دون موافقتها عملا متماشيا مع أنظمة الاتصالات اللاسلكية``.

Recognizing the sovereign right of every Administration to raise any issue at the Plenipotentiary Conference, the Board confirmed that the two representatives of the Radio Regulations Board at the 2010 Plenipotentiary Conference and its Executive Secretary will be ready to provide any relevant information and advice that might be required at the forthcoming Plenipotentiary Conference.
وأقر بالحق السيادي لكل حكومة في إثارة أي مسألة في مؤتمر المفوضين، وأكد أن ممثلََي مجلس النظم الإذاعية الاثنين في مؤتمر المفوضين لعام 2010، وأمينه التنفيذي سيكونون على استعداد لتقديم أي معلومات مناسبة، وإسداء المشورة اللازمة في مؤتمر المفوضين المقبل.

Within that framework, those delegations expressed their satisfaction with the agreement reached by the Subcommittee at its thirty-ninth session (A/AC.105/738, annex III), in the sense that coordination among countries aimed at the utilization of the geostationary orbit should be carried out in an equitable manner and in conformity with the Radio Regulations of ITU.

Such measures could include adoption of the Space Debris Mitigation Guidelines of the Committee, compliance with ITU Radio Regulations related to space services, and the development of open, transparent standards for the exchange of data necessary to avoid collisions, radio frequency interference or other harmful events.

Furthermore, at its fifty-fourth meeting, held from 5 to 13 July 2010, the Radio Regulations Board of the International Telecommunication Union adopted the following decision:
