1. The CHAIRMAN said the only remaining problem with the informal working group's new text for article 12 of the draft UNCITRAL Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication, which had been read out at the beginning of the previous meeting, was the conflict between paragraphs 3 and 7.
١ - الرئيسة: قالت إن التضارب بين الفقرتين ٣ و ٧ هو المشكلة الوحيدة المتبقية في النص الجديد الذي أعده الفريق العامل غير الرسمي للمادة ١٢ من مشروع القانون النموذجي للجنة القانون التجاري الدولي بشأن الجوانب القانونية للتبادل الالكتروني للبيانات وما يتصل بها من وسائل اﻹبلاغ، وهو النص الذي تُلي في بداية الجلسة السابقة.

It was felt that the draft Guide should make it clear that, while a few countries had adopted specific provisions to deal with certain aspects of EDI, there existed no legislation dealing with EDI and Related Means of communication as a whole.

It was stated that existing legislation governing communication and storage of information was inadequate or outdated precisely because it did not contemplate the use of EDI and Related Means of communication, thus creating uncertainty with respect to the legal regime of transactions operated by electronic means and restricting the use of such means.
وذكر أن التشريعات القائمة التي تنظم اﻹبلاغ وخزن المعلومات قاصرة أو بالية، إذ لم تتوقع تحديدا استخدام التبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ، مفضية بذلك إلى حالة من عدم اليقين فيما يتعلق بالنظام القانوني للمعاملات التي تنفذ بالوسائل اﻹلكترونية وواضعة قيودا على استخدام هذه الوسائل.

Another concern was that the words " electronic data interchange and Related Means of communication " were inappropriate.

7. In 1995, the Commission had adopted articles 1 and 3 to 11 of the draft Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication.

III. DRAFT UNCITRAL MODEL LAW ON LEGAL ASPECTS OF ELECTRONIC DATA INTERCHANGE (EDI) AND Related Means of COMMUNICATION
ثالثا - مشـروع قانـون اﻷونسيـترال النموذجـي بشــأن الجوانب القانونية للتبـادل الالكترونـي للبيانـات وما يتصل به من وسائل اﻹبلاغ

1. The CHAIRMAN said the drafting group had submitted its report and the Commission should be in a position to adopt the draft Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication.
١ - الرئيسة: قالت إن فريق الصياغة قدم تقريره وإن من المفروض أن تتمكن اللجنة من أن تعتمد مشروع القانون النموذجي بشأن الجوانب القانونية للتبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ.

60. At its twenty-eighth session, UNCITRAL had also considered the draft Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication.
٦٠ - ونظرت اللجنة أيضا، في دورتها الثامنة والعشرين، في مشروع قانونها النموذجي بشأن جوانب قانونية للتبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ.

3. Draft UNCITRAL Model Law on Legal Aspects of Electronic Data Interchange and Related Means of Communication: preparation of a guide to enactment.
٣ - مشروع قانون اﻷونسيترال النموذجي بشأن الجوانب القانونية للتبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ: إعداد دليل لسن المشروع.

It was agreed that the objectives of the Model Law were somewhat different and more limited, since the main purpose of the Model Law was to adapt existing statutory requirements so that they would no longer constitute obstacles to the use of EDI and Related Means of communication.
واتفق على أن أهداف القانون النموذجي مختلفة قليلا وأضيق نطاقا، ﻷن الغرض الرئيســي مــن القانون النموذجي هو تكييف الشروط القانونية القائمة كيلا تشكل عائقا أمام استعمال التبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ.

It was agreed that the draft Guide should emphasize that the Model Law was intended to remove statutory requirements that constituted obstacles to the increased use of EDI and Related Means of communication, irrespective of whether the users of such means of communication were linked by an interchange agreement.

In that connection, it was stated that the draft Guide should indicate as a characteristic of EDI and Related Means of communication that they covered programmable messages, the computer programming of which was the essential difference between such messages and traditional paper-based documents.

175. There was agreement in the Commission that the title of the draft Model Law ( " UNCITRAL Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication " ) was too long, and did not describe the content of the draft Model Law with sufficient clarity.

٢ - واستطرد قائلا إن الهدف من مشروع قانون اﻷونسيترال النموذجي بشأن جوانب قانونية معينة للتبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ هو تيسير استخدام وسائل اتصال حديثة في مجال التجارة الدولية.

31. The draft Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication should be limited in scope to data created, stored or exchanged in the context of commercial relationships.
٣١ - وفيما يتعلق بمشروع قانون اﻷونسيترال النموذجي بشأن جوانب قانونية للتبادل الالكتروني للبيانات وما يتصل به من وسائل اﻹبلاغ، قال إن الوفد المصري يؤيد الرأي المنادي بقصر نطاق تطبيق هذه المواد على البيانات التي يجري إنشاؤها أو تخزينها أو تبادلها في سياق العلاقات التجارية.

The CHAIRMAN said that if she heard no objection, she would take it that the Commission agreed to entrust the publication of the Guide to Enactment of the UNCITRAL Model Law on Legal Aspects of Electronic Data Interchange (EDI) and Related Means of Communication to the secretariat, which would be authorized to make changes as suggested by the Commission.
