According to UNA-Sweden/JS3, statistics for 2012 showed that 64 percent of reported hate crimes were committed directly against the victims.
وذكرت رابطة الأمم المتحدة - السويد/الورقة المشتركة 3 أن إحصاءات عام 2012 بيّنت أن 64 في المائة من جرائم الكراهية المبلغ عنها ارتكبت مباشرة ضد الضحايا.

Recalling its general recommendation No. 7 (1985) on legislation to eradicate racial discrimination and general recommendation No. 15 (1993) on article 4, the Committee recommends that the State party take immediate measures to effectively investigate and bring to justice perpetrators of reported hate crimes regardless of their official status.
إذ تذكر اللجنة بتعليقها العام رقم 7(1985) بشأن التشريع المتعلق بالقضاء على التمييز العنصري، وبتوصيتها العامة رقم 15(1993) بشأن المادة 4، توصي الدولة الطرف باتخاذ تدابير فورية للتحقيق بصورة فعالة في جرائم الكراهية المبلغ عنها وإحالة مرتكبيها إلى القضاء بغض النظر عن صفتهم الرسمية.

(10) The Committee expresses its concern at the dismissive attitudes and reluctance to accept the racist or discriminatory nature of hate crimes by the law enforcement authorities as well as the repeated incidents of ethnic and racial profiling by the police, resulting in a majority of the reported hate crimes remaining unanswered (art. 4 (a)).
(10) وتعرب اللجنة عن قلقها إزاء عدم اكتراث السلطات المعنية بإنفاذ القانون وتلكئها في قبول الطبيعة العنصرية أو التمييزية لجرائم الكراهية، فضلا عن قلقها إزاء الأحداث المتكررة للتنميط الإثني والعرقي من جانب الشرطة، مما يؤدي إلى بقاء غالبية جرائم الكراهية المبلغ عنها دون رد (الفقرة (أ) من المادة 4).

In light of its general recommendation No. 31 (2005), the Committee urges the State party to take prompt measures to effectively investigate reported hate crimes and ensure that all crimes with racial motives are prosecuted in line with national legislation and the Convention, taking into account the gravity of such acts.
وتحث اللجنة، في ضوء توصيتها العامة رقم 31(2005)، الدولة الطرف على اتخاذ تدابير فورية للتحقيق بفعالية في جرائم الكراهية المبلغ عنها وضمان مقاضاة مرتكبي جميع الجرائم ذات الدوافع العنصرية، وفقاً للتشريع الوطني والاتفاقية، مع مراعاة خطورة مثل هذه الأفعال.

The Committee expresses further concern about the consideration of forms of hate speech under " agitation " , which may result in a restrictive interpretation and the use of differing definitions of hate crime by individual law enforcement agencies, and the State party's information that it is not possible to track all reported hate crimes through the justice system (arts. 2, para. 1 (c) and (d); 4 (a); and 6).
وتعرب اللجنة عن قلقها أيضاً إزاء تصنيف أشكال من خطاب الكراهية في خانة " التحريض " ، وهو ما يمكن أن يفضي إلى وقوع فرادى وكالات إنفاذ القانون في تفسير تقيدي واستخدامها تعاريف مختلفة لجريمة الكراهية، وإزاء ما أفادت به الدولة الطرف من أنه يتعذر ملاحقة جميع جرائم الكراهية المبلغ عنها بواسطة النظام القضائي (الفقرة 1(ج) و(د) من المادة 2؛ والمادة 4(أ)؛ والمادة 6).

Furthermore, and while appreciating the State party's efforts to combat hate crimes, including the establishment of the hate-crime hotline in 2007, the Committee reiterates its concern about the increase of reported racially motivated crimes in recent years as well as the low number of prosecutions compared with the number of reported hate speech incidents (arts. 20 and 26).
كما أن اللجنة، إذ تقدر جهود الدولة الطرف في مكافحة جرائم الكراهية، بطرق شملت إنشاء خط هاتفي مباشر في عام 2007 للإبلاغ عن جرائم الكراهية، تكرر الإعراب عن قلقها إزاء تزايد الجرائم المرتكبة بدوافع عنصرية والمبلغ عنها في السنوات الأخيرة، وإزاء انخفاض عدد المحاكمات بالمقارنة مع عدد حوادث خطابات الكراهية المبلغ عنها (المادتان 20 و26).

18. Recalling its previous concluding observations, CERD referred to concerns at the prevalence of hate speech by high-ranking Government officials and recommended that Turkmenistan take immediate measures to effectively investigate and bring to justice perpetrators of reported hate crimes regardless of their official status.
18- وإذ ذكرت لجنة القضاء على التمييز العنصري بملاحظاتها السابقة، فإنها أشارت إلى القلق الذي أعربت عنه إزاء انتشار خطاب الكراهية في أوساط المسؤولين الحكوميين الرفيعي المستوى، وأوصت اللجنة تركمانستان باتخاذ تدابير فورية للتحقيق بصورة فعالة في جرائم الكراهية المبلغ عنها وإحالة مرتكبيها إلى القضاء بغض النظر عن صفتهم الرسمية(58).
