Where a contracting state makes extradition conditional on the existence of a treaty receives a request for extradition from another contracting state with which no extradition treaty exists the requested state may consider this convention as the basis for extradition in respect to the listed offences.
وعندما تتلقى دولة متعاقدة، تجعل التسليم مشروطا بوجود معاهدة، طلبا للتسليم من دولة متعاقدة أخرى لا توجد معها معاهدة تسليم فإنه يجوز للدولة المطلوب منها التسليم اعتبار هذه الاتفاقية أساس التسليم فيما يتعلق بالجرائم المذكورة فيها.

4. Should a State Party that makes extradition conditional on the existence of a treaty receive a request for extradition from another State Party with which it has no extradition treaty, it may consider this Convention as the necessary legal basis for extradition with respect to the offence of forced disappearance.
٤- إذا أخضعت دولة طرف التسليم لشرط وجود معاهدة وتلقت طلب تسليم من دولة طرف أخرى لا تربطها بها معاهدة تسليم، يجوز لهذه الدولة أن تعتبر هذه الاتفاقية بمثابة اﻷساس القانوني اللازم للتسليم فيما يتعلق بجريمة الاختفاء القسري.

7. If the State party requested to make a transfer to the Court has also received a request for extradition from a State non-party but one to which it is bound by an extradition agreement, it shall rule as in the case of concurrent requests for extradition, taking into account the following circumstances:

If a Contracting State which makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, it shall consider the present Convention as the legal basis for extradition in respect of the offences mentioned in article 1 of this Convention.
٢ - إذا تلقت دولة من الدول المتعاقدة التي تشترط وجود معاهدة لتسليم المجرمين طلب تسليم من دولة أخرى من الدول المتعاقدة لا تربطها بها معاهدة لتسليم المجرمين، فعليها أن تعتبر هذه الاتفاقية اﻷساس القانوني للتسليم فيما يتصل بالجرائم المذكورة في المادة ١ من هذه الاتفاقية.

2. If a Contracting State that makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, the requested State may at its option consider this Convention as the legal basis for extradition in respect of the offences referred to in article 2.

3. If a State Party that makes extradition conditional on the existence of a treaty receives a request for extradition from another Party with which it has no extradition treaty, it mayIt was suggested that, as demonstrated in the implementation of similarly formulated provisions in the 1988 Convention, the use of the word “may” provided States with extensive discretion, which entailed the risk of rendering such a provision ineffective.
٣ - اذا تلقت دولة طرف ، تخضع تسليم المجرمين لشرط وجود معاهدة ، طلب تسليم مجرمين من طرف آخر لا يرتبط معها بمعاهدة تسليم ، جاز لهاقيل انه قد تبين من تنفيذ أحكام مصاغة على هذا النحو في اتفاقية سنة ٨٨٩١ ، أن استخدام عبارة " جاز " تتيح للدول حرية تصرف واسعة النطاق مما يؤدي الى احتمال ابطال فعالية مثل هذا الحكم .
