72. It is vital to prevent any distinction, exclusion, restriction or preference based on religion or belief which aims at or leads to the nullification or impairment of the recognition, enjoyment or exercise of human rights and fundamental freedoms on an equal basis.
72 - ومن الحيوي منع أي شكل من أشكال التفرقة أو الاستبعاد أو التقييد أو التفضيل على أساس الدين أو المعتقد يهدف إلى إلغاء أو إعاقة الإقرار بحقوق الإنسان والحريات الأساسية أو التمتع بها أو ممارستها على أساسٍ متكافئ أو يُفضي إلى ذلك.

(m) To prevent any distinction, exclusion, restriction or preference based on religion or belief that impairs the recognition, enjoyment or exercise of human rights and fundamental freedoms on an equal basis and to detect signs of intolerance that may lead to discrimination based on religion or belief;
(م) أن تمنع أي شكل من أشكال التفرقة أو الاستبعاد أو التقييد أو التفضيل على أساس الدين أو المعتقد يعوق الإقرار بحقوق الإنسان والحريات الأساسية أو التمتع بها أو ممارستها على أساس متكافئ وأن تتحرى بوادر التعصب التي قد تقود إلى التمييز على أساس الدين أو المعتقد؛

Intolerance and discrimination based on religion or belief are defined in the Declaration as any distinction, exclusion, restriction or preference based on religion or belief and having as its purpose or as its effect nullification or impairment of the recognition, enjoyment or exercise of human rights and fundamental freedoms on an equal basis.
ويعني التعصب والتمييز القائمان على أساس الدين أو المعتقد، حسب تعريف اﻹعلان، أي تفريق أو استثناء أو تقييد أو تفضيل يقوم على أساس الدين أو المعتقد ويكون غرضه أو أثره إلغاء أو إضعاف الاعتراف بحقوق اﻹنسان، والحريات اﻷساسية أو التمتع بها، أو ممارستها على أساس من المساواة.

2. For the purposes of the present Declaration, the expression `intolerance and discrimination based on religion or belief'means any distinction, exclusion, restriction or preference based on religion or belief'and having as its purpose or as its effect nullification or impairment of the recognition, enjoyment or exercise of human rights and fundamental freedoms on an equal basis. "

36. Second, it follows from the definition provided by article 2 (2) that " any distinction, exclusion, restriction or preference based on religion or belief having as its purpose or as its effect nullification or impairment of the recognition, enjoyment or exercise of human rights and fundamental freedoms on an equal basis " constitutes discrimination.
36- وثانياً، يتضح من التعريف المنصوص عليه في المادة 2(2) أن " أي ميز أو استثناء أو تقييد أو تفضيل يقوم على أساس الدين أو المعتقد ويكون غرضه أو أثره تعطيل أو انتقاص الاعتراف بحقوق الإنسان والحريات الأساسية أو التمتع بها أو ممارستها على أساس من المساواة " يشكل تمييزاً.

37. Third, by referring to the " purpose " or " effect " of any distinction, exclusion, restriction or preference based on religion or belief, article 2 (2) of the Declaration provides protection against formal (de jure) and actual (de facto) discrimination.
37- وثالثاً، أن المادة 2(2) من الإعلان، بإشارتها إلى " الغرض " أو " الأثر " المترتب على أي ميز أو استثناء أو تقييد أو تفضيل يقوم على أساس الدين أو المعتقد، توفر الحماية من التمييز الرسمي (بحكم القانون) والتمييز الفعلي (بحكم الواقع).
