According to the resolution, the main function of the Special Rapporteur would be to " examine ways and means to overcome the obstacles existing to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are non-documented or in an irregular situation " . Specifically, the Special Rapporteur's functions are as follows:

Welcomes the decision of the Commission on Human Rights to appoint a special rapporteur on the human rights of migrants to examine ways and means to overcome the obstacles existing to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are non-documented or in an irregular situation, with the following functions:
٥ - ترحـب بقرار لجنــة حقــوق اﻹنسان تعيين مقـــرر خاص معني بحقوق اﻹنسان للمهاجرين لدراسة سبل ووسائل تخطي العقبات القائمة أمام الحماية الفعالة والكاملة لحقوق اﻹنسان لهذه الفئة المستضعفة، بما فيها العقبات والصعوبات التي تعترض عودة المهاجرين الذين ليست لديهم الوثائق اللازمة أو الذين هم في وضع غير قانوني، ويكلف باالقيام بما يلي:

Encourages the Special Rapporteur to continue examining ways and means of overcoming existing obstacles to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are nondocumented or in an irregular situation, in conformity with her mandate contained in Commission on Human Rights resolution 1999/44;

In its resolution 1999/44, the Commission on Human Rights decided to appoint, for a threeyear period, a special rapporteur on the human rights of migrants to examine ways and means to overcome the obstacles existing to the full and effective protection of the human rights of this vulnerable group, including obstacles and difficulties for the return of migrants who are non-documented or in an irregular situation.
