Article 16, paragraph 1(d), of the Convention stipulates that men and women should have the same rights and responsibilities as parents, irrespective of their marital status, in matters relating to their children; in all cases the interests of the children shall be paramount. Irrespective of marital status, Islam gives women custody of young children.
أما فيما يتعلق بنص الفقرة )د( من المادة ١٦ والتي تنص على أن نفس الحقوق والمسؤوليات كوالدة بغض النظر عن حالتها الزوجية في اﻷمور المتعلقة بأطفالها وفي جميع اﻷحوال تكون مصالح اﻷطفال هي الراجحة، فالدين اﻹسلامي قد أعطى المرأة حق الحضانة لﻷم في حالة خلافها مع زوجها طالما هي غير متزوجة.
