146 - وما إن يودع أحد الأطفال غير المصحوبين بذويهم أو المنفصلين عنهم في إطار للرعاية، ينبغي بذل جميع الجهود الممكنة لتقفي أثر أسرته وإعادة إنشاء الأواصر الأسرية التي تربطه بها، وذلك عندما يحقق هذا الأمر مصالح الطفل الفضلى ولا يعرض الأطراف المعنية للخطر.

21. Subsequent steps, such as the appointment of a competent guardian as expeditiously as possible, serves as a key procedural safeguard to ensure respect for the best interests of an unaccompanied or separated child.
21- وتشكل الخطوات اللاحقة، كتعيين وصي كفء بأسرع وقت ممكن، ضماناً إجرائياً رئيسياً لمراعاة المصالح الفضلى لطفل غير مصحوب أو منفصل عن ذويه.

States should further take into account that illegal entry into or stay in a country by an unaccompanied or separated child may also be justified according to general principles of law, where such entry or stay is the only way of preventing a violation of the fundamental human rights of the child.
وينبغي للدول أيضاً أن تضع في اعتبارها أن دخول طفل غير مصحوب أو منفصل عن ذويه إلى إقليم دولة ما أو بقاءه هناك بصورة غير شرعية، يمكن أيضاً أن يُبرر بموجب المبادئ العامة للقانون، لا سيما إذا كان دخول الطفل إلى البلد أو إقامته فيه السبيلَ الوحيد لمنع وقوع انتهاك لحقوق الإنسان الأساسية لذلك الطفل.
