6. The CHAIRMAN said that it might be possible for the drafting group to cut down on the number of adjectives used in paragraph 3(c)O to describe the nature of the services to be procured.

57. Differing views were expressed as to whether to retain subparagraph (c), which provided for an exception to wide solicitation where, because of the nature of the services to be procured, economy and efficiency could be promoted only by way of direct solicitation.

There shall be no requirement of or reference to a particular trade mark, name, patent, design, type, specific origin or producer unless there is no other sufficiently precise or intelligible way of describing the characteristics of the goods, construction or services to be procured and provided that words such as " or equivalent " are included.
ولا يذكر أي اشتراط أو إشارة بشأن علامة تجارية معينة أو اسم أو براءة أو تصميم أو نوع أو أصل محدد أو منتج معين إلا إذا لم تكن هناك طريقة أخرى دقيقة أو واضحة بما يكفي لوصف خصائص السلع أو اﻹنشاءات أو الخدمات المراد اشتراؤها وشريطة أن تدرج عبارة مثل " أو ما يعادلها " .

As regards subparagraph (a), which indicated the conditions in which use of tendering for services would be permitted, it was suggested that the words " and tendering proceedings would be more appropriate taking into account the nature of the services to be procured " should be deleted, so as to render tendering mandatory when specifications were capable of being drawn up.

(1) (a) When the procuring entity engages in restricted tendering on the grounds referred to in article 18 (a), it shall solicit tenders from all suppliers and contractors from whom the goods, construction or services to be procured are available.
