With regard to the charge of rape, it states that Mr. Shchetka confessed guilt of rape in the presence of a lawyer during the preliminary investigation, and only during the court hearings changed his testimony, accusing the police officers of falsification and use of physical force towards him.
وبخصوص تهمة الاغتصاب، تقول إن السيد شيتكا اعترف بذلك بحضور محامٍ خلال التحقيق الأولي، وأنه لم يغير أقواله إلا خلال جلسات المحكمة واتهم أفراد الشرطة بالتزوير وباستعمال القوة المادية ضده.

Mr. Shchetka had the possibility to appeal against the prosecutor's refusal to the higher prosecutor in accordance with article 99, paragraph 1, of the Ukrainian Code of Criminal Procedure, as well as in court, as prescribed by article 336, paragraph 1, of the said Code.
وكان باستطاعة السيد شيتكا أن يطعن في رفض النائب أمام نائب أعلى درجة وفقاً للفقرة 1 من المادة 99 من قانون الإجراءات الجنائية في أوكرانيا، وأمام المحاكم وفقاً للفقرة 1 من المادة 336 من ذلك القانون.

The Committee observes that Mr. Shchetka's lawyer submitted complaints to the Prosecutor's Office requesting, inter alia, for a medical examination and an investigation into his allegations of torture.
وتلاحظ اللجنة أن محامي السيد شيتكا رفع شكاوى إلى النيابة ملتمساً أموراً منها إجراء فحص طبي وتحقيق في ادعاءاته المتعلقة بالتعذيب.

However, the Committee observes that, while the State party has not provided any documentary evidence in support of its argument, Mr. Shchetka's claims are supported by the materials on file, inter alia by two complaints submitted to the prosecutor against the abuses committed by the investigative officer.
غير أن اللجنة تلاحظ أن الدولة الطرف لم تقدم أي أدلة وثائقية تدعم هذه الحجة، بينما ترد ادعاءات السيد شيتكا مدعومة بعناصر الملف ومنها شكويان مقدمتان إلى النيابة بخصوص التجاوزات الصادرة عن المحقق.
