Mr. SKIBSTED (Denmark) said that the Security Council should be competent to refer situations to the Court, but should not interfere with its proceedings in any other way.

Mr. YAÑEZ-BARNUEVO (Spain) said that his delegation considered that the Statute should make provision for the Security Council to be able to refer situations to the Court whenever crimes specified in the Statute appeared to have been committed.

I welcome progress in this regard and hope that much more can be done in the coming years, including through further accessions to the Rome Statute and referral of situations to the Court.

11. Mr. Suarte (Brazil), speaking on behalf of the Rio Group, hailed the headway made by the International Criminal Court. The decisions of the Democratic Republic of the Congo and Uganda to refer situations to the Court were commendable and indicated that States had confidence in the independence and impartiality of the Court, which was the international community's key instrument for countering impunity.
11 - السيد سوارتي (البرازيل): تكلم باسم مجموعة ريو فحيّا المحكمة وهي تمضي قُدماً على طريق التقدم وقال إن قرارات جمهورية الكونغو الديمقراطية وأوغندا بإحالة القضايا إلى المحكمة أمر محمود ويشير إلى أن الدول أصبح لديها الثقة في استقلالية وحيادية المحكمة التي تمثل الأداة الرئيسية التي يمتلكها المجتمع الدولي لمجابهة مسألة الإفلات من العقاب.

While Security Council referrals of situations to the Court had taken place on two occasions only, the mere threat of prosecution was seen as a potentially valuable tool for putting pressure on persistent perpetrators.
ومع أن مجلس الأمن لم يُحِل حالات إلى المحكمة إلا في مناسبتين، فإن مجرد التهديد بالملاحقة القضائية اعتُبر أداة قيِّمة محتملة للضغط على المتمادين في ارتكاب الانتهاكات.

This would allow any necessary special requirements to be prescribed for referral of situations to the Court by the Security Council under Chapter VII of the Charter.
