According to the information received, Mr. Soukyeh was blindfolded and handcuffed for two months and deprived of sleep.

7. On 10 January 2010, Mr. Soukyeh was granted release by order of the High Court of Justice.

Mr. Soukyeh has never been brought before a competent judicial body or offered any possibility to contest the legality of his arrest and continued detention.

According to the information received, Mr. Soukyeh was interrogated for three months, subjected to ill-treatment, including severe hitting, bound to windows, chairs and the roof of the building, in cold and rain without clothes, had cold water poured over him, sleep deprivation and insults.

Mr. Soukyeh was brought in again for interrogation on 1 September 2008.

6. The source reports that on 15 May 2008, Mr. Soukyeh was taken to the interrogation department in Jericho for additional questioning, which continued for two months.

31. It is further reported that on 26 November 2010, Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi and Nayroukh went on a hunger strike to support their request to be releases.

37. The Palestinian Authority does not refute the fact that Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi, and Nayroukh were arrested and held in detention without any legal basis, as had been alleged by the source.
37- لا تطعن السلطة الفلسطينية في أن السادة سوقية وعبيد والعويوي والبيطار والقواسمي ونيروخ اعتقلوا ووضعوا قيد الاحتجاز دون أي أساس قانوني على النحو الذي ادعاه المصدر.

38. Moreover, Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi, and Nayroukh were all subject to orders by the High Court of Justice in late 2009 and early 2010 for their immediate release.

42. The Working Group takes due note of the information provided by the Palestinian Authority that Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi, and Nayroukh were arrested on 8 January 2011 by the Israeli authorities, and decides to transmit these allegations to them.
42- ويُحيط الفريق العامل علماً على النحو الواجب بالمعلومات التي قدمتها السلطة الفلسطينية والتي مفادها أن السادة سوقية وعبيد والعويوي والبيطار والقواسمي ونيروخ اعتُقلوا يوم 8 كانون الثاني/يناير 2011 على أيدي السلطات الإسرائيلية، ويقرر نقل هذه الادعاءات إليها.

41. Consequent upon the opinion rendered, the Working Group requests the Palestinian Authority to provide Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi, and Nayroukh with an enforceable right to compensation for the period of arbitrary detention up to 7 January 2011.
41- وبناءً على هذا الرأي، يطلب الفريق العامل إلى السلطة الفلسطينية أن تمنح السادة سوقية وعبيد والعويوي والبيطار والقواسمي ونيروخ حقاً قابلاً للإنفاذ في التعويض عن فترة الاحتجاز التعسفي حتى 7 كانون الثاني/يناير 2011.

32. In the light of the foregoing, the source expressed concern that the continued detention of Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi and Nayroukh may not be in conformity with, inter alia, articles 9 and 10 of the Universal Declaration of Human Rights and principles 1, 10, 11, and 32 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
32- وفي ضوء ما تقدم، أعرب المصدر عن قلقه لأن استمرار احتجاز السادة سوقية وعبيد والعويوي والبيطار والقواسمي ونيروخ ينتهك، في جملة أمور، المادتين 9 و10 من الإعلان العالمي لحقوق الإنسان، والمبادئ 1 و10 و11 و32 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.
