That the choice of an international convention to govern a contract was not dependent upon domestic law was evidenced by article 2, paragraph 1 (e) of the United Nations Convention on the carriage of Goods by Sea, which applied to a contract of carriage, inter alia, when a bill of lading stated that the provisions of the Convention or the legislation of any state giving effect to them were to govern the contract of carriage.

Unless otherwise agreed between the States concerned, a state cannot invoke immunity from jurisdiction before a court of another state which is otherwise competent in a proceeding which relates to the carriage of cargo on board a ship owned or operated by that state if, at the time the cause of action arose, the ship was used for other than government non-commercial purposes.
4 - لا يجوز لدولة أن تحتج بالحصانة من الولاية القضائية أمام محكمة دولة أخرى، تكون من جميع الوجوه الأخرى هي المحكمة المختصة، في دعوى تتصل بنقل حمولة على متن سفينة تملكها أو تشغلها تلك الدولة إذا كانت السفينة، وقت نشوء سبب الدعوى، مستخدمة في غير الأغراض الحكومية غير التجارية، وهذا ما لم تتفق الدولتان المعنيتان على غير ذلك.

3. " Nothing in this Convention prevents a contracting state from applying the provisions of any other international convention regarding the carriage of goods to the contract of carriage to the extent that such international convention according to its provision applies to the carriage of goods by different modes of transport. "

" In judicial proceedings by the shipper or other cargo interest against the maritime performing party relating to carriage of goods under this instrument, the claimant, at its option, may institute an action in a court in a state party which, according to the law of the state where the court is situated, is competent and within the jurisdiction of which is situated one of the following places:

39. Prior to the approval of the draft convention by the Commission, the definition of " contract of carriage " and the terms of draft article 5 should therefore be clearly amended to bring within the scope of the draft convention all carriage by sea where the actual port of loading or the actual port of discharge was in a contracting state.
39- وأعرب عن رأي مفاده أنه، ينبغي، قبل أن توافق اللجنة على مشروع الاتفاقية، إدخال تعديل على تعريف " عقد النقل " والشروط الواردة في مشروع المادة 5 يجعل من الواضح أن جميع عمليات النقل البحري مشمولة بمشروع الاتفاقية حين يكون ميناء التحميل الفعلي أو ميناء التفريغ الفعلي واقعا في دولة متعاقدة.

1- يجوز لأي دولة لدى التوقيع أو التصديق أو القبول أو الموافقة أو الانضمام، أن تحتفظ بحق استبعاد تطبيق المادة 27 من هذه الاتفاقية وجميع الأحكام الأخرى المتعلقة بالنقل السابق أو اللاحق للنقل البحري.

60. UNCLOS only addresses the carriage of dangerous goods by ships in the territorial sea. Article 22 gives the coastal state the right in its territorial sea to require ships carrying nuclear or other inherently dangerous or noxious substances or materials to confine their passage to such sea lanes, as it may designate, taking into account the recommendations of the competent international organization.
60 - إن اتفاقية الأمم المتحدة لقانون البحار لا تتناول سوى نقل البضائع الخطرة بالسفن داخل البحر الإقليمي وتمنح المادة 22 الدولة الساحلية داخل بحرها الإقليمي الحق في أن تفرض على السفن التي تحمل مواد نووية أو غيرها من المواد والمنتجات ذات الطبيعة الخطرة أو المؤذية أن تقصر مرورها على تلك الممرات البحرية التي قد تعينها الدولة الساحلية، آخذة بعين الاعتبار توصيات المنظمة الدولية المختصة.

China's view is, since paragraph 1 of Article 14 of the Convention provides for the carrier's responsibility for the goods, and Article 18 provides for the basis of liability of the carrier, an article that would change or extend the period of the seaworthiness of ship will, under the current state of development of carriage by sea, greatly increase the burden on carriers, which will be overly demanding for carriers.
2- وبما أنّ الفقرة 1 من المادة 14 من الاتفاقية تنص على تحمّل الناقل مسؤولية البضائع، وتنص المادة 18 على أساس مسؤولية الناقل، فإنّ الصين ترى أنّ إدراج أي مادة تغيّر أو تطيل مدة صلاحية السفينة للإبحار، سيؤدي، في الحالة الراهنة من تطوّر النقل البحري، إلى زيادة العبء الملقى على عاتق الناقلين زيادة كبيرة، الأمر الذي سيكون مرهقا للناقلين أكثر مما ينبغي.
