The independent expert has also noted the recommendations made by the treaty bodies to the State Party at the time of presentation of its reports and was able to be present at the consideration of the report of Haiti by the Committee on the Elimination of Discrimination against Women in January 2009 (CEDAW/C/HTI/7).

482. While appreciating that the Constitution and laws of the State party may be used in many instances to prohibit private actors from engaging in acts of racial discrimination, the Committee remains concerned about the wide scope of the reservation entered by the State Party at the time of ratification of the Convention with respect to discriminatory acts perpetrated by private individuals, groups or organizations (art. 2).
482- وبينما تعرب اللجنة عن تقديرها لجواز استخدام دستور الدولة الطرف وقوانينها في حالات عديدة لمنع الجهات الخاصة من ممارسة أفعال التمييز العنصري فإنها تظل قلقة إزاء النطاق الواسع للتحفظ الذي أبدته الدولة الطرف عند تصديقها على الاتفاقية فيما يخص الأفعال التمييزية الصادرة عن أفراد أو عن جماعات أو منظمات خاصة (المادة 2).

واقترح اتباع النهج المعتمد في المادة ٣١)١( من اتفاقية الامتيازات والرهون البحرية، بأن تُضاف في نهاية الفقرة الجملة التالية: " بشرط أن تخضع سفينة الدولة غير المتعاقدة موضع الحجز للولاية القضائية للدولة الطرف وقت الحجز " .
