6- إذا اختارت الدولة الطرف أن تجعل اتخاذ التدابير المشار اليها في الفقرتين 1 و 2 من هذه المادة مشروطا بوجود معاهدة بهذا الشأن، وجب على تلك الدولة الطرف أن تعتبر هذه الاتفاقية بمثابة الأساس التعاهدي اللازم والكافي.

2. For the purposes of this Protocol, each State Party shall consider the illegal entry into or illegal residence in the territory of any other State Party equal to illegal entry into or illegal residence in its own territory.
٢ - ﻷغراض هذا البروتوكول ، يتعين على كل دولة طرف أن تعتبر الدخول غير المشروع أو الاقامة غير المشروعة في اقليم أي دولة طرف أخرى مساويا للدخول غير المشروع أو الاقامة غير المشروعة في اقليمها هي .

3. Each State Party shall consider monitoring its policies and actual measures to combat organized crime and making assessments of their effectiveness and efficiency.
٣- يتعين على كل دولة طرف أن تنظر في رصد سياساتها وتدابيرها الفعلية لمكافحة الجريمة المنظمة، وأن تجري تقييمات لفعالية تلك السياسات والتدابير ونجاعتها.

2. Each State Party shall consider adopting such legislative and other measures as may be necessary to establish as criminal offences conduct referred to in paragraph 1 of this article involving a foreign public official or international civil servant.
2- يتعين على كل دولة طرف أن تنظر في اعتماد ما قد يلزم من تدابير تشريعية وتدابير أخرى لتجريم السلوك المشار اليه في الفقرة 1 من هذه المادة الذي يضلع فيه موظف عمومي أجنبي أو موظف مدني دولي.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- يتعين على كل دولة طرف أن تنظر في امكانية منح الحصانة من الملاحقة لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة المتعلقة بجرم مشمول بهذه الاتفاقية، وفقا للمبادىء الأساسية لقانونها الداخلي.

3. Each State Party shall consider monitoring its policies and actual measures to combat organized crime and making assessments of their effectiveness and efficiency.
3- يتعين على كل دولة طرف أن تنظر في رصد سياساتها وتدابيرها الفعلية لمكافحة الجريمة المنظمة، وفي اجراء تقييمات لفعالية تلك السياسات والتدابير ونجاعتها.

3. Each State Party shall consider implementing measures to provide for the physical, psychological and social recovery of victims of trafficking in persons, including, in appropriate cases, in cooperation with non-governmental organizations, other relevant organizations and other elements of civil society, and, in particular, the provision of:
3- يتعين على كل دولة طرف أن تنظر في تنفيذ تدابير تتيح التعافي الجسدي والنفساني والاجتماعي لضحايا الاتجار بالأشخاص، بما في ذلك، في الحالات المناسبة، بالتعاون مع منظمات غير حكومية وسائر المنظمات ذات الصلة وغيرها من عناصر المجتمع الأهلي، وخصوصا توفير ما يلي:

5. Each State Party shall consider taking measures that permit, in accordance with its domestic law, the denial of entry or revocation of visas of persons implicated in the commission of offences established in accordance with this Protocol.
5- يتعين على كل دولة طرف أن تنظر في اتخاذ تدابير تسمح، وفقا لقانونها الداخلي، بعدم الموافقة على دخول الأشخاص المتورطين في ارتكاب جرائم مقررة وفقا لهذا البروتوكول، أو الغاء تأشيرات سفرهم.

2. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- يتعين على كل دولة طرف أن تنظر في اتاحة امكانية اللجوء، في الحالات المناسبة، الى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في اجراءات التحقيق أو الملاحقة بشأن احدى الجرائم المشمولة بهذه الاتفاقية.

1. Each State Party shall consider analysing, in consultation with the scientific and academic communities, trends in organized crime in its territory, the circumstances in which organized crime operates, as well as the professional groups and technologies involved.
1- يتعين على كل دولة طرف أن تنظر في القيام، بالتشاور مع الأوساط العلمية والأكاديمية، بتحليل الاتجاهات السائدة في الجريمة المنظمة داخل اقليمها، والظروف التي يعمل فيها الاجرام المنظم، وكذلك الجماعات المحترفة الضالعة والتكنولوجيات المستخدمة.

1. In addition to taking measures pursuant to article 6 of this Protocol, each State Party shall consider adopting legislative or other appropriate measures that permit victims of trafficking in persons to remain in its territory, temporarily or permanently, in appropriate cases.
1- بالاضافة الى اتخاذ التدابير عملا بالمادة 6 من هذا البروتوكول، يتعين على كل دولة طرف أن تنظر في اعتماد تدابير تشريعية أو تدابير أخرى مناسبة تسمح لضحايا الاتجار بالأشخاص، في الحالات المناسبة، بالبقاء داخل اقليمها مؤقتا أو دائما.

6. If a State Party elects to make the taking of the measures referred to in paragraphs 1 and 2 of this article conditional on the existence of a relevant treaty, that State Party shall consider this Convention the necessary and sufficient treaty basis.

6- إذا اختارت الدولة الطرف أن تجعل اتخاذ التدابير المشار إليها في الفقرتين 1 و2 من هذه المادة مشروطا بوجود معاهدة بهذا الشأن، على تلك الدولة الطرف أن تعتبر هذه الاتفاقية بمثابة الأساس التعاهدي اللازم والكافي.

2. For the purposes of this Protocol, each State Party shall consider the illegal entry into or illegal residence in the territory of any other State Party equal to illegal entry into or illegal residence in its own territory. At the fourth session of the Ad Hoc Committee, one delegation suggested that this subparagraph should be either deleted or moved to the chapter on jurisdiction or criminalization.
٢ - ﻷغراض هذا البروتوكول ، يتعين على كل دولة طرف أن تعتبر الدخول غير المشروع أو الاقامة غير المشروعة في اقليم أي دولة طرف أخرى مساويا للدخول غير المشروع أو الاقامة غير المشروعة في اقليمها هي .في الدورة الرابعة للجنة المخصصة ، اقترح أحد الوفود إما حذف هذه الفقرة الفرعية وإما نقلها الى الفصل المتعلق بالولاية القضائية أو بالتجريم .
