Migrant workers participate in the workforce and the economy of States of employment, and thus usually contribute to social insurance schemes, benefiting the whole range of scheme as right-holders.

In doing so, States of employment shall take into account the special needs and obligations of migrant workers and members of their families, in particular in their States of origin.

(16) States of employment should identify a relevant judicial authority to which domestic workers can address their labour rights' concerns, independently of their legal status, such as a domestic workers Ombudsman.

1. Where separate authorizations to reside and to engage in employment are required by national legislation, the States of employment shall issue to migrant workers authorization of residence for at least the same period of time as their authorization to engage in remunerated activity.

Account shall be taken of the period during which the worker has already been lawfully in the State of employment.

2. States of employment shall consider favourably granting frontier workers the right freely to choose their remunerated activity after a specified period of time.

2. The rights of migrant workers vis-à-vis their employer arising from employment shall not be impaired by these measures.

49. States of employment should ensure that all migrant domestic workers have access to mechanisms for bringing complaints about violations of their rights (articles 18, paragraph 1, and 83).
