" Establishes the following list of candidates in accordance with article 12 of the Statute of the International Tribunal for Rwanda:

In that connection, I wish to direct the Assembly's attention to the provision of article 12, paragraph 1 of the Statute of the International Tribunal for Rwanda, which reads as follows:

Note: Article 2, paragraph 2, of the Statute of the International Tribunal for Rwanda applies analogously to the Makobola massacre.

Regarding crimes against humanity, article 3 of the Statute of the International Tribunal for Rwanda stresses the prosecution of persons responsible for crimes " when committed as part of a widespread or systematic attack against any civilian population on national, political, ethnic, racial or religious grounds " , that is, it does not associate those crimes primarily with armed conflicts.
وفيما يخص الجرائم المرتكبة ضد اﻹنسانية، تشدد المادة ٣ من النظام اﻷساسي للمحكمة الدولية لرواندا على محاكمة اﻷشخاص المسؤولين عن الجرائم " إذا ارتكبت كجزء من هجوم واسع ومنهجي على أي مدنيين ﻷسباب وطنية أو سياسية أو إثنية أو عرقية أو دينية " . أي أنها لا تربط هذه الجرائم بصفة أساسية بالصراعات المسلحة.

Article 4 of the Statute of the International Tribunal for Rwanda expressly included both provisions, setting aside that argument, which was not totally convincing from a legal point of view, and remedying, at least in that case, one of the main weaknesses of international law.

As members may recall, by its resolution 955 (1994) of 8 November 1994, the Security Council adopted the Statute of the International Tribunal for Rwanda.
