Slovenia fully supported the principle of the supremacy of international law with regard to direct and individual responsibility for crimes against the peace and security of mankind. It also believed that the rules and principles applicable to individual responsibility - and to the various forms of complicity - envisaged in article 2 were clearly drafted and consistent with the rules of international law.

The International Law Commission had similarly encapsulated the commitment to the international rule of law in article 14 of its 1949 Declaration on Rights and Duties of States, which stated that every State had the duty to conduct its relations with other States in accordance with international law and with the principle that the sovereignty of each State was subject to the supremacy of international law.
