The present Swedish Aliens Act entered into force in 2006.

As to the admissibility of the communication, the State party further explains that according to the Swedish Aliens Act, the author may at any time lodge a new application for a residence permit with the Aliens Appeal Board, based on new factual circumstances which have not previously been examined.

The complainant concluded that his risk of being subjected to torture constitutes an absolute impediment to his expulsion to the Syrian Arab Republic under the Swedish Aliens Act and articles 3 of the Convention and of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
وخلص صاحب الشكوى إلى أن خطر التعرض للتعذيب يشكل مانعاً جازماً أمام ترحيله إلى الجمهورية العربية السورية بموجب قانون الأجانب السويدي والمادة 3 من الاتفاقية والمادة 3 من الاتفاقية الأوروبية لحماية حقوق الإنسان والحريات الأساسية.

4.4 As regards its assessment of whether or not the author would be personally at risk of being subjected to torture if returned to the Islamic Republic of Iran, the State party draws the attention of the Committee to the fact that several of the provisions of the Swedish Aliens Act reflect the same principle as the one laid down in article 3, paragraph 1 of the Convention.
4-4 وفيما يتعلق بتقييم احتمالات تعرض صاحبة البلاغ شخصيا للتعذيب إذا ما أُعيدت إلى إيران، توجه الدولة الطرف انتباه اللجنة إلى أن عدداً من أحكام قانون الأجانب السويدي تنص على نفس المبدأ الوارد في الفقرة 1 من المادة 3 من الاتفاقية.

7.2 The State party adds that, on 13 September 2011, the Migration Board decided to reject a request from the complainants for a re-examination of their case pursuant to chapter 12, sections 18 and 19 of the Swedish Aliens Act (Act).
7-2 وتضيف الدولة الطرف أن مجلس الهجرة قرر، في 13 أيلول/سبتمبر 2011، رد طلب مقدم من أصحاب الشكوى لإعادة النظر في قضيتهم عملاً بالمادتين 18 و19 من الفصل 12 من قانون الأجانب السويدي (القانون)().

On 3 July 2009, the Migration Board decided not to grant residence permits under chapter 12, section 18, of the Swedish Aliens Act (Act) and not to grant a re-examination of the question of residence permits under chapter 12, section 19, of the Act.
