By denying Syrian nationality to Kurdish children deprived of a nationality, the Syrian Arab Republic was contravening article 7 of the Convention, which enshrined the right of every child to a nationality, in particular where the child would otherwise be stateless.
وبِحَجبِ الجنسية السورية عن اﻷطفال اﻷكراد المحرومين من الجنسية، فإن الجمهورية العربية السورية تخالف المادة ٧ من الاتفاقية، التي كرست حق كل طفل في جنسية، لا سيما حيث يصبح الطفل بدونها عديم الجنسية.

" Syrian law shall apply to any Syrian person who, when outside Syrian territory, commits, instigates or is involved in a crime or misdemeanour punishable under Syrian law. يطبق القانون السوري على كل سوري فاعلا كان أو محرضا أو متدخلا أقدم خارج الأرض السورية على ارتكاب جناية أو جنحة يعاقب عليها القانون السوري ويبقى الأمر كذلك ولو فقد المدعي عليه الجنسية السورية أو اكتسبها بعد ارتكاب الجناية أو الجنحة.

Moreover, the Committee regrets that children of Syrian-born Kurdish parents who are stateless and have no other nationality at birth continue to be denied Syrian nationality and are subject to discrimination, contrary to articles 2 and 7 of the Convention.

٥٣- وفيما يخص الحصول على الجنسية السورية، يحتوي القانون على أحكام تسمح بمعاملة إنسانية لحالات محددة ومعزولة جداً، ولكنه لا ينص على منح الجنسية السورية ﻷجانب دخلوا سورية بطرق غير قانونية ﻷغراض سياسية أو ﻷهداف أخرى.

(b) Mr. Taraq Shukri, born 1982in Damascus in 1982, of Syrian nationality , and living in Qudsyya, Damascus, was arrested on 28 June 2000 by members of Public Security Forces, and detained at Adra Prison.;

Article 3 of the Syrian nationality Act stipulates as follows:
" يعتبر عربياً سورياً حكماً:

126. Under article 20 of the Syrian Criminal Code, Syrian law applies to every Syrian abroad who commits, instigates or is an accessory to a serious or a major offence which is punishable under Syrian law. The same rule applies to persons who have forfeited Syrian nationality or who acquire it after committing a serious or a major offence.
126- جاء النص في المادة 20 من قانون العقوبات السوري على أن يطبق القانون السوري على كل سوري فاعلاً كان، أو محرضاً أو متدخلاً، أقدم خارج الأرض السورية على ارتكاب جناية أو جنحة يعاقب عليها القانون السوري، ويبقى الأمر كذلك ولو فقد المدعى عليه الجنسية السورية، أو اكتسبها بعد ارتكاب الجناية أو الجنحة.
