3 - تكفل الدول الأطراف عدم فصل أي طفل عن أبويه رغما عنهما إلا إذا قررت سلطات مختصة، وفقا للقوانين والإجراءات الوطنية المنطبقة عموما ورهنا بمراجعة قضائية أو أية أشكال أخرى من المراجعة الإدارية يحددها القانون، أن هذا الفصل ضروري لمصلحة الطفل العليا.

The Working Group recalls that, pursuant to article 9, paragraph 1, of the Convention on the Rights of the Child, a child may be separated from his or her parents against their will, when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.

3.3 The author maintains that according to article 9 of the Convention on the Rights of the Child, the State party must ensure that a child is not separated from his/her parents against their will, except when competent authorities, subject to judicial review, determine in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.
3-3 ويدعي صاحب البلاغ أنه، وفقاً لأحكام المادة 9 من اتفاقية حقوق الطفل، يتعين على الدولة الطرف أن تضمن عدم فصل الطفل عن والديه رغم إرادتهما، إلا عندما تقرر السلطات المختصة، رهناً بإجراء إعادة نظر قضائية، وفقاً للقانون والإجراءات المعمول بها، أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

According to article 9, paragraph 1, of the Convention States parties shall ensure that a child shall not be separated from his or her parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.
(ج) ووفقاً للفقرة 1 من المادة 9 من الاتفاقية تضمن الدول الأطراف عدم فصل الطفل عن والديه على كره منهما، إلا عندما تقرر السلطات المختصة، رهناً بإجراء إعادة نظر قضائية، وفقاً للقوانين والإجراءات المعمول بها، أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

(a) Take effective measures to implement fully the legislation relating to alternative care of children to ensure that a child is not separated from his or her parents against its will, except when competent authorities subject to judicial review and procedures determine that such separation is necessary for the best interests of the child; and
(أ) اتخاذ تدابير فعالة لتنفيذ التشريع المتعلق بالرعاية البديلة للطفل تنفيذاً كاملاً لضمان عدم فصل الطفل عن أبويه غصباً عنه، إلا إذا قررت السلطات المختصة، التي تخضع لمراجعة وإجراءات قضائية، أن هذا الفصل لازم لخدمة مصالح الطفل الفضلى؛

(c) To ensure as far as possible the right of the child to know and be cared for by his or her parents, and to ensure that a child shall not be separated from his or her parents against their will, except when the competent authorities, subject to judicial review, determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child, in conformity with article 9 of the Convention;
