The Minister for Justice is concerned with the administration of the courts, prisons and legal registries in the Fiji Islands.

But the Governor retains direct responsibility for (and is not required to consult the Executive Council on) certain matters, notably defence, external affairs, internal security (including police), the public service and the administration of the courts.

46. The administration of justice was undermined by a number of difficulties, such as the question surrounding the independence and impartiality of the justice system, the administration of the courts and services, the absence of judicial statistics, the insufficient budget for courts, the slowness of the legal process, long pretrial detentions, the technical quality of contested decisions and the existence of corruption.
46 - وقد عرقل عدد من الصعوبات إقامة العدل، مثل المسائل المتعلقة باستقلال النظام القضائي ونزاهته، وإدارة المحاكم والخدمات، وعدم توافر الإحصاءات القضائية، وعدم كفاية الميزانية المخصصة للمحاكم، وبطء العملية القانونية، وطول مدة الاحتجاز السابق للمحاكمة، والنوعية الفنية للقرارات المطعون عليها، ووجود الفساد.

The majority of members of the Commission had proposed the adoption of a new system whereby the courts would be administered by an independent body under the direction of a council elected partly by the deputies and partly by the Government, while a minority of the Commission's members wanted the administration of the courts to continue to be entrusted to the Ministry of Justice.
وأشارت في هذا الصدد إلى أن أغلبية أعضاء اللجنة اقترحت اعتماد نظام جديد يقضي بأن تتولى إدارة شؤون المحاكم هيئة مستقلة يترأسها مجلس ينتخب النواب بعض أعضائه وتنتخب الحكومة بعضهم الآخر، وبينت أن أقلية من أعضاء اللجنة أعربت عن رغبتها في أن تظل إدارة شؤون المحاكم من اختصاص وزارة العدل.

The Committee expresses its concern at the challenges facing the administration of justice in the State party, including the non-execution of court decisions, inefficiency and limited professionalism in the administration of the courts, the lack of adequate courtrooms, the shortage of interpreters and the high levels of corruption. (art. 14)
23- وتعرب اللجنة عن قلقها إزاء التحديات التي تواجه إقامة العدل في الدولة الطرف، بما فيها عدم تنفيذ قرارات المحاكم وقصور الكفاءة ومحدوديتها في إدارة شؤون المحاكم وعدم وجود قاعات كافية ونقص عدد المترجمين الفوريين وارتفاع معدلات الفساد. (المادة 14 من العهد)
