In this connection, reference should be made to the provisions of the Constitution of the FRY, the Charter on Human Rights and the Constitution of the RS.

39. Furthermore, in its Article 67 the Constitution of the FRY provides for that the freedoms and rights of man and the citizen are exercised and duties fulfilled in conformity with the Constitution.

50. Besides Article 20 of the Constitution of the FRY mentioned above, it should be noted that the Constitution of the FRY also provided for the protection of certain categories of the population, i.e. children, expectant mothers and the elderly.

The provision about special protection of the family, mothers and children is also contained in the Constitution of the FRY (Article 61).

344. In this context the Constitution of the FRY and the aforementioned Articles 54, 55, 56 and 57, referring to the right to work and the rights and duties in the area of work are of particular interest.

38. The freedoms, rights and duties of man and the citizen are regulated in a separate section of the Constitution of the FRY (Official Gazette of the FRY, No. 1/92).
38 - يجري تنظيم حريات الإنسان والمواطن وحقوقه وواجباته في قسم منفصل من دستور جمهورية يوغوسلافيا الاتحادية (الجريدة الرسمية لجمهورية يوغوسلافيا الاتحادية، العدد 1/92).

49. Consistent implementation of the Convention is ensured by the Constitution of the FRY, the Constitutional Charter, the Charter on Human Rights, the Constitution of the RS as well as by series of legal enactments, the basis of which, as already pointed out, is equality of citizens irrespective of sex.

Paragraph 3 of the same Article was established to be contrary to the Constitution of the FRY if, at the request of the competent military authority, it was established that, by leaving the country, a person requesting a travel document or a visa sought to avoid the obligation of doing National Service or any other service in the Army of Yugoslavia.

65 - ينبغي استرعاء النظر إلى المادة 3 من ميثاق حقوق الإنسان المشار إليها فيما سبق التي توفر ضمانا عاما للمساواة، وذلك بالإضافة إلى أحكام دستور جمهورية يوغوسلافيا الاتحادية (المادة 20) ودستور جمهورية صربيا (المادة 13) المذكورة آنفا والمتعلقة بمبدأ المساواة بين جميع المواطنين بغض النظر عن أية اختلافات.
