Recalling its previous concluding observations (CEDAW/C/ISR/CO/3, para. 23), the Committee regrets the State party's position that the Convention does not apply beyond its own territory and, for that reason, the fourth and fifth periodic reports did not provide any information on the status of implementation of the Convention in the Occupied Palestinian Territories.
12- تُذكِّر اللجنة بملاحظاتها الختامية السابقة (CEDAW/C/ISR/CO/3، الفقرة 23)، وتُعرب عن أسفها إزاء موقف الدولة الطرف الذي يعتبر أن الاتفاقية لا تنطبق خارج إقليمها وأن هذا هو سبب خلو التقريرين الدوريين الرابع والخامس من أي معلومات عن حالة تنفيذ الاتفاقية في الأراضي الفلسطينية المحتلة.

The State party points out in particular that the Convention does not guarantee the right not to be returned to a country where there are substantial grounds for believing that the person would face a real risk of a violation of the right to life, of being subjected to torture, or of a violation of the right to protection against any inhuman or cruel and unusual punishment, and that the Convention does not apply extraterritorially.

According to this provision, the Convention does not apply to an international contract when it is not apparent either from the contract or from the dealings between the parties that they are located in two different States.
