As a result of these considerations, we are of the view that the author has failed to substantiate his claim that the decision of the State party to deport him to Pakistan would violate article 6, paragraph 1, and article 7 of the Covenant and accordingly find no violation of the Covenant by Canada.
8- ونتيجة لهذه الاعتبارات، فإننا نرى أن صاحب البلاغ لم يؤيد بالأدلة ادعاءه بأن قرار الدولة الطرف المتعلق بترحيله إلى باكستان ينطوي على انتهاك للفقرة 1 من المادة 6 وللمادة 7 من العهد، وتبعاً لذلك فإننا نخلص إلى أن كندا لم تنتهك العهد بحال من الأحوال.

As a result of these considerations, we are of the view that the author has failed to substantiate his claim that the decision of the State party to deport him to Pakistan would violate articles 6 (para. 1) and 7 of the Covenant read in conjunction with article 2, paragraph 3, of the Covenant and accordingly find no violation of the Covenant by Canada.
8- ونتيجة لهذه الاعتبارات، فإننا نرى أن صاحب البلاغ لم يؤيد بالأدلة ادعاءه بأن قرار الدولة الطرف المتعلق بترحيله إلى باكستان ينطوي على انتهاك للفقرة 1 من المادة 6 والمادة 7 من العهد مقروءتين بالاقتران مع الفقرة 3 من المادة 2 من العهد، وتبعاً لذلك فإننا نخلص إلى أن كندا لم تنتهك العهد.

In the light of the above, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the decision of the State party to return the complainant to Ethiopia would not constitute a violation of article 3 of the Convention.
8- وفي ضوء ما ورد ذكره أعلاه، تستنتج لجنة مناهضة التعذيب، عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن القرار الذي اتخذته الدولة الطرف بشأن إعادة صاحبة الشكوى إلى إثيوبيا لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

In the circumstances the Committee, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, is of the view that the decision of the State party to return the author to Sri Lanka would not constitute a breach of article 3 of the Convention.
٧ - وفي هذه الظروف، ترى لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة ٧ من المادة ٢٢ من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن القرار الذي اتخذته الدولة الطرف بإعادة مقدم البلاغ إلى سري لانكا لن يشكل انتهاكا للمادة ٣ من الاتفاقية.

In particular, he has failed to show that the decision of the State party not to exercise its right to diplomatic protection in his case was based not on legitimate considerations of foreign policy but exclusively on his Sudeten German descent.
ولم يبين صاحب البلاغ بوجه خاص أن الأسباب الكامنة وراء قرار الدولة الطرف عدم ممارسة حقها في الحماية الدبلوماسية لا تتعلق باعتبارات مشروعة تدخل في نطاق السياسة الخارجية وإنما تتعلق بانتسابه إلى ألمان منطقة السوديت.

In the present case, the author failed to establish that the decision of the State party not to bring criminal charges in connection with the specific statements delivered by Mr. Krarup, Mr. Messerschmidt and Mr. Camre had actually affected him, or that the specific consequences of the said decision were imminent and would affect him personally.
2- وفشل صاحب البلاغ، في الحالة الراهنة، في إثبات أن قرار الدولة الطرف المتمثل في عدم توجيه تهم جنائية بخصوص التصريحات التي أدلى بها كل من السيد كراروب والسيد ميسرشميدت والسيد كامر ألحق به الضرر فعلاً، أو أن عواقب القرار المذكور كانت وشيكة وستؤثر فيه شخصياً.

The Committee also regrets the decision of the State party not to include family planning services in the State budget.
وتأسف اللجنة أيضاً لقرار الدولة الطرف بعدم إدراج خدمات تنظيم الأسرة في ميزانية الدولة.

In the light of the above, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the decision of the State party to expel the complainants to Yemen would not constitute a violation of article 3 of the Convention.
8- وفي ضوء ما ورد ذكره أعلاه، تخلص لجنة مناهضة التعذيب، وهي تتصرف عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن القرار الذي اتخذته الدولة الطرف بشأن إعادة أصحاب الشكوى إلى اليمن لا يشكل انتهاكاً للمادة 3 من الاتفاقية.
