If, after reasonable effort, the carrier is unable to locate the shipper, the carrier may so advise the documentary shipper and request instructions in respect of the delivery of the goods;
وإذا تعذر على الناقل، بعد بذل جهد معقول، تحديد مكان الشاحن، جاز للناقل أن يبلغ الشاحن المستندي بذلك وأن يطلب منه تعليمات بشأن تسليم البضاعة.

If, after reasonable effort, the carrier is unable to locate the shipper, the carrier may so advise the documentary shipper and request instructions in respect of the delivery of the goods;

A term in the contract of carriage according to which the liability of the shipper or the documentary shipper will cease, wholly or partly, upon a certain event or after a certain time is void:
عندما ينصّ شرط في عقد النقل على أنّ مسؤولية الشاحن أو الشاحن المستندي ستتوقف كليا أو جزئيا عند وقوع حدث معيّن أو بعد وقت معيّن، يكون ذلك الشرط باطلا:

If, after reasonable effort, the carrier is unable to locate the controlling party or the shipper, the carrier shall so advise the documentary shipper, and the documentary shipper shall give instructions in respect of the delivery of the goods;
وإذا ما تعذّر على الناقل، بعد بذل جهد معقول، تحديد مكان الطرف المسيطر أو مكان الشاحن، وجب على الناقل أن يُبلغ الشاحن المستندي بذلك، ووجب على الشاحن المُستندي أن يُصدر تعليمات بشأن تسليم البضاعة؛

وإذا تعذّر على الناقل، بعد بذل جهد معقول، تحديد مكان الشاحن، وجب على الشاحن المستندي تقديم تلك المعلومات أو التعليمات أو المستندات.

According to paragraph 2 of this article, any term in the contract is void that excludes or limits the obligations and the liability of the shipper, the consignee, the controlling party or the documentary shipper.
20- وفقا للفقرة 2 من هذه المادة، يكون أي شرط في العقد باطلا إذا كان يستبعد واجبات ومسؤولية الشاحن أو المرسل إليه أو الطرف المسيطر أو الشاحن المستندي أو يحدّ منها.

There is nothing to be gained from mentioning the documentary shipper in article 1, paragraph 9, and what follows without stating its role and obligations.

It is not clear that the consent of the documentary shipper or the consignee is required prior to them being responsible for, among other things, the unloading of the goods.

A concern was expressed that draft article 34 was too broad in subjecting the documentary shipper to all of the obligations of the shipper.

In response to a question whether the documentary shipper and the shipper could be found to be jointly and severally liable, the view was expressed that there was not intended to be joint and several liability as between the two.

(a) The shipper is the controlling party unless the shipper, when the contract of carriage is concluded, designates the consignee, the documentary shipper or another person as the controlling party;
