336. The Committee acknowledges the measures recently adopted by the State party to implement the 2001 judgement of the InterAmerican Court of Human Rights in the Awas Tingni case, but remains concerned at the constant delays in the demarcation and land titling of the traditional territory of the Awas Tingni community.

The State party should also, in keeping with the judgement of the InterAmerican Court of Human Rights in the Tibi case, set up an interagency committee to draw up and implement training programmes in human rights and the treatment of prisoners.

45. The Public Prosecutor's office has also ordered prosecutors in any of the courts that tried cases in which the amnesty laws were applied to request implementation of the rulings of the InterAmerican Court of Human Rights.
45- وفيما يتعلق بمكاتب النيابة العامة، صدرت تعليمات لجميع وكلاء النيابة الذين نظروا في قضايا طُبقت فيها قوانين العفو بأن يطالبوا بتنفيذ الأحكام الصادرة عن محكمة البلدان الأمريكية لحقوق الإنسان(44).

The Committee urges the State party to proceed immediately with the demarcation and land titling of the lands of the Awas Tingni community, without prejudice to the rights other communities may have in accordance with the criteria established in the judgement of the InterAmerican Court of Human Rights and in general recommendation XXIII (para. 5).
تحث اللجنةُ الدولة الطرف على أن تشرع فوراً في ترسيم حدود أراضي جماعة أواس تينغي وفي منحها ملكية هذه الأراضي، دون مساسٍ بالحقوق التي قد تؤول إلى جماعاتٍ أخرى وفقاً للمعاير المنصوص عليها في الحكم الصادر عن محكمة البلدان الأمريكية لحقوق الإنسان وفي التوصية العامة الثالثة والعشرين (الفقرة 5).

Nonetheless, the Committee feels that, in line with the ruling of the InterAmerican Court of Human Rights in the case of Almonacid Arellanos y otros of 26 September 2006, the fact that this decreelaw remains in force leaves the application of the amnesty up to the judgement of the domestic courts.

(b) In January 2003, the InterAmerican Commission on Human Rights decided to bring the case before the InterAmerican Court of Human Rights and lodged a complaint against the Government of Mexico concerning the alleged violations mentioned above;

28- وعلى الصعيد الإقليمي أدت لجنة البلدان الأمريكية لحقوق الإنسان ومحكمة البلدان الأمريكية لحقوق الإنسان دوراً رائداً في صياغة مجموعة بارزة من السوابق القانونية فيما يتعلق بحقوق الشعوب الأصلية في الأمريكتين، وما نجم عن ذلك من أثر معياري هام في مناطق أخرى.

Mr. KLEIN said that the advisory opinion of the InterAmerican Court of Human Rights was very helpful in the case of paragraph 14.

For instance, the InterAmerican Court of Human Rights has issued an important advisory opinion in which it makes clear that, under the American Convention on Human Rights, the principle of equality and non-discrimination is an erga omnes human rights principle, and therefore it fully applies to the labour conditions of migrant workers, whether documented or undocumented.

49. The Seminar recommends that recent legislation opening the way for indigenous peoples to use institutional machinery to protect their lands and territory, and the case law of the InterAmerican Court of Human Rights upholding the protection of collective rights, should be publicized and acknowledged.
49- وتوصي الحلقة الدراسية بتعميم ما صدر مؤخراً من قوانين تفسح المجال للشعوب الأصلية لاستخدام الآليات المؤسسية لحماية أراضيها وأقاليمها، وما سبق أن أصدرته محكمة البلدان الأمريكية لحقوق الإنسان من أحكام تقرّ حماية الحقوق الجماعية، كما توصي بالاعتراف بهذه القوانين والأحكام.
