By his activities, the author had breached paragraph 18, part 2, of the Law on Lawyers, and, in accordance with article 32 of the Qualification Commission Regulations, the Minister of Justice correctly refused to issue his lawyer's licence.

4.1 On 17 December 2004, the State party explained that pursuant to article 11 of the Law on Lawyers, the Qualification Commission is empowered to determine who is entitled to practise as a lawyer.
4-1 في 17 كانون الأول/ديسمبر 2004، أوضحت الدولة الطرف أن المادة 11 من قانون المحاماة تنص على أن لجنة تقييم مؤهلات المحامين تملك الصلاحية لتحديد من يملك الحق في مزاولة مهنة المحاماة.

It recalls its previous observations and adds that the author's allegations that the Ministry of Justice should not have taken into account the fact that he had participated in an unauthorized rally in order not to issue his lawyer's licence are in contradiction with the current legislation, in particular article 24 of the Law on Lawyers.
وذكّرت بملاحظاتها السابقة وأضافت أن ادعاء صاحب البلاغ بأنه ما كان ينبغي لوزارة العدل أن تأخذ مشاركته في تجمع غير مأذون به في الحسبان ضمن اعتبارات رفض إصدار ترخيص مزاولة المحاماة، هو ادعاء يتناقض مع التشريعات المعمول بها حالياً، ولا سيما مع المادة 24 من قانون المحاماة.

In this case, the State party had limited itself to explaining that the author had been fined lawfully, under the provisions of the Code of Administrative Offences, which, as a consequence, had led to the subsequent non-issuance of his licence as a lawyer, in the light of the provisions of the Law on Lawyers.
ولاحظت اللجنة أن الدولة الطرف قد اكتفت في هذه القضية بالتوضيح بأن تغريم صاحب البلاغ كان قانونياً بموجب الأحكام المنصوص عليها في قانون الجرائم الإدارية، وهو ما ترتب عليه حرمانه في وقت لاحق من الحصول على ترخيص مزاولة المحاماة في ضوء الأحكام المنصوص عليها في قانون المحاماة.

13.4 The Committee notes that in the present case, the State party has limited itself in explaining that the author had been fined lawfully, under the provisions of the Code of Administrative Offences, which, as a consequence, had led to the subsequent non-issuance of his licence as a lawyer, in light of the provisions of the Law on Lawyers.

the Law on Lawyers was revised in October 2007 and its revisions are yet to be reflected in the Criminal Procedure Law.
وقد نُقِّح قانون المحاماة في تشرين الأول/أكتوبر 2007 ولا يزال ينتظر إدماج التنقيحات المدخلة عليه في قانون الإجراءات الجنائية(62).

The State party has not addressed these claims specifically considering these provisions of the Covenant, but has explained that the author's licence was not issued because, by having his administrative liability engaged for participation in an unauthorized meeting in violation of a Presidential Decree on Mass Actions, he had breached his duties as a lawyer set out in the Law on Lawyers.
ولم تتناول الدولة الطرف هذه الادعاءات واضعة أحكام العهد هذه تحديداً في الاعتبار، ولكنها أوضحت أن صاحب البلاغ لم يحصل على الترخيص لأنه يكون بثبوت مسؤوليته الإدارية عن المشاركة في تجمع غير مأذون به قد خرق المرسوم الرئاسي المتعلق بالأنشطة الجماهيرية، وأخل بذلك بما يفرضه عليه قانون المحاماة من واجبات كمحام.
