Any rules to be elaborated by the judges would be of a subsidiary nature, conforming to the elements and principles laid down in the Statute. It was also proposed that the Court should be allowed to draw upon the major legal systems of the world to establish general principles of criminal law, the application of which would be subject to the approval of the States parties to the Statute.

While CARICOM was broadly satisfied with the progress made by the Working Group on General Principles of Criminal Law and its examination of the proposals before the Preparatory Committee, it believed that the principles should bridge the differences between the major legal systems of the world, and approach that should be adopted by delegations when considering procedural matters relevant to the establishment of the court.

Mr. MORSHED (Bangladesh) said that the functions contemplated in draft article 13 should be performed by a pre-trial chamber, its composition based on the principle of equitable geographical representation and reflecting the major legal systems of the world.
٢٢ - السيد مرشد )بنغلاديش( : قال ان المهام المعتزمة لمشروع المادة ٣١ ينبغي أن تضطلع بها دائرة تمهيدية ، وأن يستند تكوينها الى مبدأ التمثيل الجغرافي العادل وأن تعكس النظم القانونية الرئيسية في العالم .

Subparagraph (c), it was stated, should be amended to make it clear that national law was a subsidiary means for determining general principles of law common to the major legal systems or, alternatively, should clearly indicate the relevant national law, the State whose law would apply and the circumstances in which such law would apply, particularly as national law was far from uniform.

In order for the court to be effective, however, it must be universally acceptable from the standpoint of all the major legal systems and geographical regions in the world.
