In our criminal law, the rule is that the offender benefits from the provisions that are more favourable to his legal position in the proceedings in order to ensure that the provisions of the law are properly applied to the facts of the case in keeping with the principle that the penalty to be imposed should be that which the legislature had in mind when designating certain acts as punishable criminal offences.

3. In considering the penalty to be imposed on a person convicted under this Statute, the Court shall take into account the extent to which a penalty imposed by another court on the same person for the same act has already been served.
٣ - تأخذ المحكمة في اعتبارها، لدى النظر في العقوبة التي يتعين توقيعها على شخص أدين بمقتضى هذا النظام اﻷساسي، ما يمكن أن يكون قد نُفﱢذ من عقوبة وقعتها محكمة أخرى على هذا الشخص عن ذات الفعل.

٥ - لا تكون المناقشات التي تجري بين المدعي العام والدفاع بشأن تعديل التهم الواردة في قرار الاتهام، أو قبول اعتراف المتهم بذنبه، أو العقوبة التي ستفرض، ملزمة قانونا للدائرة)٨(.

Regarding the allegation that the legally prescribed penalty for bribery does not exceed three years, the Government recalls that article 103 of the Criminal Code prescribes hard labour for life as the penalty for bribery, although the court may exceptionally reduce the penalty to a minimum of three years.
وفيما يتعلق بالادعاء بأن عقوبة الرشوة المنصوص عليها قانونا لا تتجاوز ثلاث سنوات، أشارت الحكومة إلى أن المادة 103 من القانون الجنائي تعاقب على الرشوة بالأشغال الشاقة المؤبدة، وإن كان يمكن للمحكمة بصورة استثنائية تخفيض العقوبة إلى ثلاث سنوات كحد أدنى.

Reduces the penalty to a term of imprisonment of two to five years for offenders who have not yet been prosecuted and who shall have freed the persons arrested, falsely imprisoned or detained before the tenth full day of such arrest, detention or false imprisonment is over.

(5) في الحالات التي تكون فيها الجرائم المذكورة أعلاه قد ارتُكبت من جانب زوج أو زوجة، أو سليل مباشر، أو شقيق أو شقيقة، أو شخص يتبنى طفلاً، أو وصي، أو مُعلم، أو مدرس، أو شخص يتولى الرعاية، أو من جانب أشخاص آخرين عليهم التزام بالقيام بالحماية والإشراف، عن طريق التأثير غير المبرَّر استناداً إلى الخدمة العامة أو علاقات الخدمة، تُزاد العقوبة المفروضة بمقدار النصف.
