Where preselection proceedings have been used, the criteria shall be the same as those used in the preselection proceedings.

1. Invitation to the preselection proceedings
١ - الدعوة الى اجراءات الاختيار اﻷولي

The laws of many countries identify publications, usually the official gazette or other official publication, in which the invitation to the preselection proceedings is to be published.
وتحدد قوانين بلدان كثيرة المنشورات التي ينبغي أن تنشر فيها الدعوة الى اجراءات الاختيار اﻷولي ، وهي في العادة الجريدة الرسمية أو غيرها من المنشورات الرسمية .

For purposes of transparency, it is desirable for the law to provide that, where the contracting authority reserves the right to reject a proposal on those or similar grounds, adequate notice of that circumstance must be included in the invitation to the preselection proceedings.

In order to promote transparency and competition, it is advisable that the invitation to the preselection proceedings be published in a manner that reaches an audience wide enough to provide an effective level of competition.
٠٤ - بغية تشجيع الشفافية والتنافس ، من المستصوب أن تنشر الدعوة الى اجراءات الاختيار اﻷولي بطريقة تجعلها تبلغ جمهورا واسعا يكفي لتوفير مستوى فعال من التنافس .

With a view to fostering participation of foreign companies and maximizing competition, the contracting authority may wish to cause the invitations to the preselection proceedings to be published also in a language customarily used in international trade, in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation.
وبهدف تعزيز مشاركة الشركات اﻷجنبية ومضاعفة التنافس ، قد ترغب الهيئة المتعاقدة في أن تنشر الدعوة الى اجراءات الاختيار اﻷولي كذلك باﻷسلوب المستخدم عادة في التجارة الدولية ، في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية أو مجلة تقنية أو مهنية متخصصة ذات صلة وواسعة الانتشار دوليا .

Following the preselection of bidders, it is advisable for the contracting authority to review its original feasibility study and the definition of the output and performance requirements and consider whether a revision of those requirements is needed in the light of the information obtained during the preselection proceedings.
٨٥ - عقب الاختيار اﻷولي لمقدمي العروض ، من المستصوب أن تقوم الهيئة المتعاقدة باعادة النظر في دراستها اﻷصلية لجدوى المشروع وفي تحديدها لاشتراطات النواتج واﻷداء ، والبت فيما اذا كان ثمة حاجة الى تنقيح تلك الاشتراطات على ضوء المعلومات المتحصلة أثناء اجراءات الاختيار اﻷولي .

The host country may wish to provide that, upon completion of the preselection proceedings, the contracting authority should invite the preselected bidders to submit final proposals with price with respect to the technical specifications or performance indicators and contractual terms.
)٣( قد يرغب البلد المضيف في أن يضع أحكاما تنص على أنه حال اتمام اجراءات الاختيار اﻷولي ، ينبغي للهيئة المتعاقدة أن تدعو مقدمي العروض الذين وقع عليهم الاختيار اﻷولي الى تقديم اقتراحات نهائية مشفوعة بأسعار فيما يتعلق بالمواصفات التقنية أو مؤشرات اﻷداء والشروط التعاقدية .

This may be particularly the case when an invitation to the preselection proceedings or a request for proposals has been issued but no applications or proposals were submitted, or all proposals were rejected by the contracting authority, and when, in the judgement of the contracting authority, issuing a new request for proposals would be unlikely to result in a project award.

The host country may wish to provide that direct negotiations might be further resorted to when an invitation to the preselection proceedings or a request for proposals has been issued but no applications or proposals were submitted, or all proposals were rejected by the contracting authority, and when, in the judgement of the contracting authority, issuing a new request for proposals would be unlikely to result in a project award.
)٥١( وقد يرغب البلد المضيف في أن يضع أحكاما تنص على امكان اللجوء أيضا ، الى المفاوضات المباشرة عندما تكون الدعوة الى اتخاذ اجراءات الاختيار اﻷولي أو طلب الاقتراحات قد صدرا ولكن لم تقدم أي طلبات أو اقتراحات ، أو عندما تكون الهيئة المتعاقدة قد رفضت جميع الاقتراحات ، وكذلك عندما ترى الهيئة المتعاقدة أن من غير المرجح أن يسفر اصدار طلب اقتراحات جديد عن ارساء المشروع .
