Recalling also the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions adopted by the Economic and Social Council in its resolution 1989/65 of 24 May 1989,

He reminds Governments, inter alia, of their obligations, reflected in the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions, to conduct exhaustive and impartial investigations into all suspected cases of extrajudicial, summary or arbitrary executions.

the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, endorsed by the General Assembly in its resolution 44/162 of 15 December 1989 spell out, inter alia, the following principles regarding investigations on allegations of extrajudicial, summary or arbitrary executions.
٠٥- تنص المبادئ المتعلقة بالمنع والتقصي الفعﱠالين لعمليات اﻹعدام خارج نطاق القانون واﻹعدام التعسفي واﻹعدام بإجراءات موجزة التي أيدتها الجمعية العامة في قرارها ٤٤/٢٦١ المؤرخ في ٥١ كانون اﻷول/ديسمبر ٩٨٩١، ضمن أمور اخرى، على المبادئ التالية فيما يخص التحقيقات بشأن ادعاءات وقوع حالات اﻹعدام بلا محاكمة أو بإجراءات موجزة أو اﻹعدام التعسفي.

The Special Rapporteur based his analysis on several international instruments falling within his mandate (see E/CN.4/1994/7, paras. 9-10), and in particular the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, endorsed by the General Assembly in its resolution 44/162, adopted by consensus on 15 December 1989.

The Meeting recommended that States in the region, being firmly committed to the protection of human rights, seek to bring their domestic legislation into conformity with the American Convention on Human Rights, taking also into account the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (Economic and Social Council resolution 1989/65, annex).

This obligation is confirmed in other international human rights instruments, including the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions and the Declaration on the Protection of All Persons from Enforced Disappearance.
وهذا الالتزام تؤكده صكوك حقوق الإنسان الدولية الأخرى بما فيها مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة والإعلان المتعلق بحماية جميع الأشخاص من الاختفاء القسري.

In this connection, the Special Rapporteur wishes to draw the Government's attention to the standards pertaining to the investigation of extrajudicial executions contained in the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.

In accordance with principle 19 of the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, blanket amnesty laws prohibiting the prosecution of alleged perpetrators and violating the rights of victims should not be endorsed.
ووفقا للمبدأ ٩١ من مبادئ المنع والتقصي الفعالين لعمليات اﻹعدام خارج نطاق القانون واﻹعدام التعسفي واﻹعدام دون محاكمة لا ينبغي اعتماد قوانين عفو شاملة تحظر ملاحقة المرتكبين المزعومين لهذه اﻷفعال وتنتهك حقوق الضحايا.

The Special Rapporteur holds the opinion that the establishment of an international fund for reparation payments should be considered so as to allow for fair and adequate compensation to the victims' families in accordance with paragraph 20 of the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.

To that end, the Rules should provide detailed guidance on the purpose, modalities and overall parameters of effective investigation and documentation of torture and other ill-treatment, as reflected in the Principles on Effective Investigation and the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.
