17. It should be recalled that paragraph E of the advisory opinion states that: " the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law " .
17 - وتجدر الإشارة إلى أن الفقرة هاء من الفتوى تنص على " أن التهديد بالأسلحة النووية أو استخدامها مخالف بصورة عامـة لقواعد القانون الدولي المطبق في أوقات النـزاع المسلح وخاصة مبادئ القانون الدولي الإنساني وقواعده " .

4. In the conduct of military operations at sea or in the air, each Party to the conflict shall, in conformity with its rights and duties under the rules of international law applicable in armed conflict, take all reasonable precautions to avoid losses of civilian lives and damage to civilian objects.
4- يتخذ كل طرف في النزاع كافة الاحتياطات المعقولة عند إدارة العمليات العسكرية في البحر أو في الجو، وفقاً لما له من حقوق وما عليه من واجبات بمقتضى قواعد القانون الدولي التي تطبق في المنازعات المسلحة، لتجنب إحداث الخسائر في أرواح المدنيين وإلحاق الخسائر بالممتلكات المدنية.

Secondly, the Court determined that the threat or use of nuclear weapons in general would be contrary to the rules of international law applicable in armed conflict, and in particular to the principles and rules of international humanitarian law.

3. Such destruction or seizure was not permitted under the rules of international law applicable in armed conflict at sea or in the air.

4. Paragraph 1 does not apply if the funding is intended to support acts that are not contrary to the rules of international law applicable in cases of armed conflict.
4 - لا تسري الفقرة 1 إذا كان الغرض من التمويل دعم أعمال لا تتنافى مع قواعد القانون الدولي السارية في حالة النزاع المسلح.

Paragraph E of the advisory opinion of the International Court of Justice on the legality of the threat or use of nuclear weapons states that " the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law " .
وتنص الفقرة هاء من فتوى محكمة العدل الدولية بشأن مشروعية التهديد بالأسلحة النووية أو استخدامها على أن " التهديد بالأسلحة النووية أو استخدامها يُعد بشكل عام مخالفا لقواعد القانون الدولي المطبقة في النزاعات المسلحة، ولا سيما مبادئ وقواعد القانون الإنساني " .

Negotiations to achieve nuclear disarmament also take their cue from the advisory opinion of the International Court of Justice, according to which `the threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law'.
وتستند المفاوضات من أجل تحقيق نزع السلاح النووي أيضاً إلى فتوى محكمة العدل الدولية التي قضت بأنّ التهديد باستخدام الأسلحة النووية أو استخدامها هو على العموم منافٍ لقواعد القانون الدولي السارية على النزاع المسلح ولا سيما لمبادئ وقواعد القانون الإنساني.

7. “Perfidy” means, without prejudice to the rules of international law applicable in armed conflict at sea or in the air, any acts of inviting the confidence of an adversary to lead him to believe that he is entitled to, or is obliged to accord, protection under the rules of international law applicable in armed conflict, with intent to betray that confidence.
٧ - يقصد بمصطلح " الغدر " ومع عدم اﻹخلال بقواعد القانون الدولي المطبقة على الصراع المسلح في البحر أو في الجو، أي أعمال يقصد بها كسب ثقة طرف معاد وحمله على الاعتقاد أنه يتمتع بالحماية، وأنه ملزم بمنح الحماية، بموجب قواعد القانون الدولي المطبقة على الصراع المسلح، وذلك بقصد خيانة تلك الثقة.
