This question concerns the combined legal effects of a reservation and the reactions it has prompted, and is to some extent separate from that of the intention of the States or international organizations concerned.

أما الفقرة الثانية فتقر بأنه، استثناءً لهذا المبدأ عن المبدأ المتمخض عن المبدأين التوجيهيين المذكورين، فإن تَصَرُّف الدول أو المنظمات الدولية المعنية قد يعادل، حسب الظروف، سواءً الموافقة على الإعلان التفسيري أم الاعتراض عليه.

It should be noted that the commentaries to this guideline in the relevant report of the International Law Commission as well as the thirteenth report of the Special Rapporteur establish that " A divergence of views between the States or international organizations concerned can be resolved only through the intervention of an impartial third party with decision-making authority " .
55 - وينبغي ملاحظة أن شرح هذا المبدأ التوجيهي في تقرير لجنة القانون الدولي ذي الصلة وكذلك في تقرير المقرر الخاص الثالث عشر ينص على أن " تباين الآراء بين الدول أو المنظمات الدولية المعنية لا يمكن تسويته إلا بتدخل طرف ثالث نزيه مخَوَّل البت في هذا الشأن " ().
