According to general comment 13 of the Committee, article 14 of the Covenant applied not only to procedures for the determination of criminal charges but also to procedures to determine their rights and obligations in a suit at law.

By reference to the jurisprudence of the European Court of Human Rights, they claim that article 14, paragraph 1, is applicable to the proceedings concerning their request for an exception from the zoning regulations, as well as their appeals against the demolition orders, since these proceedings determined their rights and obligations in a suit at law.
وبالإشارة إلى السوابق القضائية للمحكمة الأوروبية لحقوق الإنسان، يدعي صاحبا البلاغ أن الفقرة 1 من المادة 14، تنطبق على الإجراءات المتعلقة بطلبهما الحصول على استثناء من أنظمة التقسيم إلى مناطق، إضافة إلى طعونهما في أوامر الهدم، نظراً إلى أن تلك الإجراءات حددت حقوقهما والتزاماتهما في دعوى قضائية.
