5. In all cases, and in particular in all matters relating to this article, the best interests of the child shall be a primary consideration, and a child who is capable of forming his or her own views shall have the right to express those views freely, the views of the child being given due weight in accordance with the age and maturity of the child.

340. The Committee recommends that the State party take all necessary measures, e.g. amending its legislation, to fully reflect article 12 of the Convention so that any child " who is capable of forming his or her own views " can express those views freely.

In this regard, the Special Rapporteur recalls article 12 of the Convention on the Rights of Child, which provides that States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.

Also please provide information on the extent to which their opinions are considered and/or respected (art. 25).
