38. In light of the foregoing, the Working Group, considering that the violations of the international norms relating to the right to a fair trial are of sufficient gravity as to give the deprivation of liberty an arbitrary character, renders the following Opinion:
38- وفقاً لما تقدّم، وإذ يرى الفريق العامل أن انتهاكات القواعد الدولية المتعلقة بالحق في محاكمة عادلة هي في هذه الحالة من الخطورة بحيث تضفي على تدابير الحرمان من الحرية طابعاً تعسفياً، فإنه يصدر الرأي التالي:

37. In the light of the foregoing, the Working Group, considering that the violations of international norms relating to the right to due process and to a fair trial are of such gravity as to give the deprivation of liberty an arbitrary character, renders the following Opinion:
