New article 4. Response to the notice of arbitration.
المادة الجديدة 4: الرد على الإشعار بالتحكيم

We consider it unnecessary to include the requirement of a response to the notice of arbitration, since it alters the structure of the Rules in the following ways:
نرى أنه ليس من الضروري إدراج شرط الرد على الإشعار بالتحكيم، إذ إنه يغيّر هيكل القواعد على الأوجه التالية:

Instances of prisoners accused of offences under common law who had been detained for years without having been tried or brought before a judge at regular intervals were also brought to the notice of the authorities.
ورفعت إلى علم السلطات عدة حالات لسجناء متهمين بجرائم بموجب القانون العام وقد قضوا سنوات في الاحتجاز دون أن يحاكموا أو يمثلوا أمام قاض على فترات منتظمة.

1. Within 30 days of the receipt of the notice of arbitration, the respondent shall communicate to the claimant a response to the notice of arbitration, which shall include:
1- يُرسِل المدَّعَى عليه إلى المدَّعِي، في غضون 30 يوما من تاريخ تسلُّم الإشعار بالتحكيم، ردّاً على ذلك الإشعار يتضمّن ما يلي:

Another proposal was made to provide that the response to the notice of arbitration was only indicative.
وذهب اقتراح آخر إلى النص على أن الرد على الإشعار بالتحكيم هو مجرد إشارة لا أكثر.

It was pointed out that the respondent State needed time to organize its defence and to prepare its response to the notice of arbitration.
وأُشير إلى أن الدولة المدعى عليها تحتاج إلى وقت لتنظيم دفاعها وإعداد ردها على الإشعار بالتحكيم.

It was said that not all States were necessarily prepared to deal with publication of the notice of arbitration in a timely manner and that the respondent State would need time to organize its defence and to prepare its response to the notice of arbitration.
وقيل إنَّ الدول لن تكون كلها بالضرورة مستعدة لمعالجة نشر الإشعار بالتحكيم في توقيت مناسب، وإنَّ الدولة المدعى عليها سوف تحتاج إلى وقت لتنظيم دفاعها وإعداد ردّها على الإشعار بالتحكيم.

The respondent may elect to treat its response to the notice of arbitration in article 4 as a statement of defence, provided that the response to the notice of arbitration also complies with the requirements of paragraph 2 of this article.
ويجوز للمدّعى عليه أن يعتبر ردّه على الإشعار بالتحكيم بمقتضى الفقرة 4 بمثابة بيان دفاع، شريطة أن يفي الرد على الإشعار بالتحكيم أيضا بمقتضيات الفقرة 2 من هذه المادة.

2. The response to the notice of arbitration may also include:
2- يجوز أن يتضمّن الرد على الإشعار بالتحكيم أيضا ما يلي:

Anticipating this plea in the response to the notice of arbitration at the very beginning of the arbitral proceedings when the arbitral tribunal still has to be appointed should be omitted.
إنّ إدراج هذا الدفع في الرد على الإشعار بالتحكيم في بداية إجراءات التحكيم عندما لا تكون هيئة التحكيم قد تعيّنت بعد ينبغي حذفه.

Proposal: My comment on articles 3 and 4 dealt in detail with the manner in which the Draft introduces a response to the notice of Arbitration.

Experience shows that a response to the notice of arbitration is not necessary in order to constitute the tribunal, and the Rules have functioned very well without that requirement.
