1. Article 4 (2) (13) further regulates the disposal of confiscated assets as follows: " The funds or assets confiscated shall devolve to the State, which may allocate them to a fund for combating organized crime or drug trafficking.

2 - وتقوم الأحكام ذات الصلة المتعلقة بمسؤولية الدول عن الأفعال غير المشروعة دولياً على أساس أن العون أو المساعدة والتوجيه والسيطرة والإكراه أمور لا تؤثر على إسناد التصرف إلى الدولة التي تلقت العون أو المساعدة أو التي تعرضت للتوجيه أو السيطرة أو الإكراه.

Thus, the intention behind an alternative interpretation might be a refusal, accompanied by an interpretation seeking merely to make a recommendation to the State which formulated the initial interpretative declaration; on the other hand, it might be a refusal through which the opposing State or international organization seeks to formulate its own interpretative declaration.

)أ( متى أعلنت المحكمة عن عدم اختصاصها أو عدم مقبولية الدعوى، بعد تقديم الشخص الملاحق قضائيا إلى المحكمة، ينقل ذلك الشخص إلى الدولة التي قدمته إلى المحكمة، ما لم توافق تلك الدولية على ترتيب بديل؛

(c) The reasoned decision of the Pre-Trial Chamber shall be communicated as soon as possible to all the parties to the proceedings and to the State which requested deferral of the investigation, even if it did not take part in the proceedings.
(ج) يبلغ قرار الدائرة التمهيدية المعلل في أقرب وقت إلى كل الأطراف في الإجراءات وكذا إلى الدولة التي طلبت إحالة التحقيق حتى في الحالة التي لا تكون فيه هذه الدولة طرفا في الإجراءات.
