2. Accession to the United Nations treaties on outer space

The Subcommittee recommended that those international intergovernmental organizations that had not yet made such declarations should consider taking steps to encourage their members to adhere to the United Nations treaties on outer space, thereby enabling their acceptance of the rights and obligations under those treaties.
وأوصت اللجنة الفرعية المنظمات الحكومية الدولية التي لم تصدر بعد إعلانات من هذا القبيل بأن تنظر في اتخاذ خطوات لتشجيع أعضائها على الانضمام إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي، مما يمكّنها من قبول الحقوق والالتزامات المنصوص عليها في تلك المعاهدات.

That delegation was of the view that certainty in the application of space law would encourage Member States to accede to the United Nations treaties on outer space.

The session was followed by a round-table discussion, which focused on identifying the benefits to States parties to the United Nations treaties on outer space.

To assist that process, the Workshop recommended that the Office for Outer Space Affairs of the Secretariat write an official letter to the governmental bodies of States that were not yet parties to the United Nations treaties on outer space, referring to General Assembly resolutions and other official documents.
وللمساعدة في تلك العملية، أوصت حلقة العمل بأن يبعث مكتب شؤون الفضاء الخارجي التابع للأمانة العامة برسالة رسمية إلى الهيئات الحكومية لدى الدول التي هي ليست بعد أطرافا في معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي، يُشير فيها إلى قرارات الجمعية العامة وسائر الوثائق الرسمية.

(a) Member States are predisposed to ratify or accede to the United Nations treaties on outer space and are able to complete the necessary procedures during the biennium;

That delegation was of the view that certainty in the application of space law would encourage Member States to accede to the United Nations treaties on outer space.
ورأى الوفد أن اقتران اليقين بتطبيق قانون الفضاء سيشجّع الدول الأعضاء على الانضمام إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي.

One of the recommendations that emanated from the Workshop was the continuation of that series of workshops, focusing on building capacity in space law, particularly with reference to the United Nations treaties and principles on outer space.
ودعت إحدى التوصيات الصادرة عن حلقة العمل إلى مواصلة تنظيم سلسلة حلقات العمل تلك، بالتركيز على بناء القدرات في مجال قانون الفضاء، لا سيما بالرجوع إلى معاهدات الأمم المتحدة ومبادئها بشأن الفضاء الخارجي.

The view was expressed that the transfer of space technology would increase the level of participation of developing countries in space activities and serve as an incentive for such countries to adhere to the United Nations treaties on outer space.

2. An understanding was reached in Turkey to accede to the United Nations treaties on outer space, and legislative requirements necessary for accession are expected to be finalized before the end of 2002.
2- تم التوصل في تركيا إلى تفاهم على الانضمام إلى معاهدات الأمم المتحدة بشأن الفضاء الخارجي، ويتوقع انجاز المقتضيات التشريعية اللازمة للانضمام قبل نهاية عام 2002.

Those delegations expressed the view that further consideration should be given to the implications of transfers under the space assets protocol with respect to the United Nations treaties on outer space, as well as to the Constitution and Convention and Radio Regulations of ITU.
وأعربت تلك الوفود عن رأي بأنه ينبغي إيلاء المزيد من الاعتبار للتبعات التي تنطوي عليها حالات نقل الملكية بمقتضى بروتوكول الموجودات الفضائية بالنسبة إلى معاهدات الأمم المتحدة بشأن الفضاء الخارجي، وكذلك بالنسبة إلى دستور الآيتيو واتفاقيته ولوائح الاتصالات الراديوية الخاصة به.

The Workshop agreed that States could better protect their legitimate rights and interests in the peaceful exploration and use of outer space by becoming parties to the United Nations treaties on outer space.
27- واتفقت حلقة العمل على أن بإمكان الدول أن تعزز حماية حقوقها ومصالحها المشروعة في الاستكشاف والاستخدام السلميين للفضاء الخارجي بانضمامها إلى معاهدات الأمم المتحدة المتعلّقة بالفضاء الخارجي.

The next logical step will be to accede to the United Nations treaties on outer space in the near future, which will probably lead to national initiatives, including legislative initiatives.
أما الخطوة المنطقية التالية التي ستخطوها إستونيا فهي الانضمام في المستقبل القريب إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي، والتي من المرجح أن تفضي إلى اتخاذ مبادرات وطنية، تشمل مبادرات تشريعية.

Some delegations expressed the view that the lack of a definition and delimitation of outer space had not hindered space exploration nor discouraged States from becoming parties to the United Nations treaties on outer space.
62- وأبدت بعض الوفود رأيا مفاده أن عدم وجود تعريف للفضاء الخارجي وتعيين لحدوده لم يعرقل استكشاف الفضاء ولم يثبط الدول عن الانضمام إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي.

43. More States and organizations should accede to the United Nations treaties on outer space; and the legal provisions themselves should be improved to respond to contemporary problems.
43 - ومضى يقول إنه ينبغي لمزيد من الدول والمنظمات أن تنضم إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي، كما يتعين تحسين الأحكام القانونية نفسها بحيث تتصدى للمشاكل المعاصرة.

The view was expressed that the lack of awareness of the benefits deriving from adherence to the United Nations treaties on outer space needed to be addressed by the Legal Subcommittee in order to broaden the participation of Member States.
194- وأُعرب عن رأي مفاده أنه ثمة حاجة إلى أن تتناول اللجنة الفرعية القانونية مسألة عدم الوعي بالفوائد التي تُجنى من الانضمام إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي، من أجل توسيع نطاق مشاركة الدول الأعضاء.

The view was expressed that the law-making process undertaken by the Subcommittee should be supported in order to further promote adherence to the United Nations treaties on outer space.
46- وأُبدي رأي مفاده أنَّ عملية صوغ الأحكام القانونية التي تضطلع بها اللجنة الفرعية ينبغي أن تُدعم من أجل المُضي في تعزيز الانضمام إلى معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي.

20. The Workshop urged all States that had not yet become parties to the United Nations treaties on outer space to consider ratifying or acceding to them.
20- وحثت حلقة العمل كل الدول التي لم تصبح بعد أطرافا في معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي على أن تنظر في التصديق عليها أو الانضمام اليها.

The Working Group suggested that the Secretary-General of the United Nations might write letters to the ministers of foreign affairs of States that had not yet become parties to the United Nations treaties on outer space.
11- واقترح الفريق العامل أن يبعث الأمين العام للأمم المتحدة برسائـل إلى وزراء خارجية الدول التي لم تصبح بعد أطرافا في معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي.

The view was expressed that the Protocol was not intended to affect the rights and obligations of States parties to the United Nations treaties on outer space and to the instruments of ITU.
114- وأُبدي رأي مفاده أنَّ البروتوكول لا يراد به أن يمس بحقوق وواجبات الدول الأطراف في معاهدات الأمم المتحدة المتعلقة بالفضاء الخارجي وفي صكوك الاتحاد الدولي للاتصالات.

The Subcommittee noted with satisfaction that the Secretariat had updated and distributed a document containing information, as at 1 January 2005, on States parties and additional signatories to the United Nations treaties and other international agreements relating to activities in outer space (ST/SPACE/11/Add.1/Rev.2).
25- ولاحظت اللجنة الفرعية بارتياح أن الأمانة قامت بتحديث وتوزيع وثيقة تتضمن، حتى 1 كانون الثاني/يناير 2005، معلومات عن الدول الأطراف في معاهدات الأمم المتحدة وغيرها من الاتفاقات الدولية المتعلقة بالأنشطة في الفضاء الخارجي والدول الإضافية الموقّعة عليها (ST/SPACE/11/Add.1/Rev.2).

The Subcommittee noted with satisfaction that the Secretariat had updated and distributed a document containing information, as at 1 January 2004, on States parties and additional signatories to the United Nations treaties and other international agreements relating to activities in outer space (ST/SPACE/11/Add.1/Rev.1).
28- ولاحظت اللجنة الفرعية بارتياح أن الأمانة قد قامت بتحديث وتعميم وثيقة تتضمن المعلومات عن الدول الأطراف والدول الأخرى الموقّعة على معاهدات الأمم المتحدة والاتفاقات الدولية الأخرى المتعلقة بالأنشطة في الفضاء الخارجي حتى 1 كانون الثاني/يناير 2004 (ST/SPACE/11/Add.1/Rev.1).

Noting that nothing in the conclusions of the Working Group or in the present recommendations constitutes an authoritative interpretation or a proposed amendment to the United Nations treaties on outer space,
