Where indigenous peoples have been deprived of lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, the Committee on the Elimination of Racial Discrimination has found that the State should take steps to return those lands and territories.

(c) Guarantee indigenous peoples just and fair compensation for lands, territories and natural resources that they have traditionally owned or otherwise occupied and used, and which have been confiscated, taken, occupied, used or damaged without their free, prior and informed consent;
(ج) أن تضمن حصول الشعوب الأصلية على تعويض منصف وعادل عن الأراضي والأقاليم والموارد الطبيعية التي كانت تملكها تقليدياً أو تشغلها أو تستخدمها ثم صودرت أو أُخذت أو شغلت أو استغلت أو خربت دون الحصول على موافقة تلك الشعوب المسبقة الحرة والواعية؛

64. In this Recommendation, the Committee also especially called upon States parties to recognize and protect the rights of indigenous peoples to own, develop, control and use their communal lands, territories and resources and, where they have been deprived of their lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, to take steps to return those lands and territories.

(b) [makes no sense] ConsideringIn view of indigenous peoples' right to self-determination and right to lands, territories and resources, traditionally owned or otherwise occupied and used, be governed by, and give full effect to, the principle of free, prior and informed consent for any description of, access to, or acquisition of elements of, indigenous peoples' cultural heritage;
(ب) تخضع لمبدأ الموافقة الحرة والمسبقة والمستنيرة فيما يتعلق بأي تصنيف لعناصر التراث الثقافي للشعوب الأصلية أو الوصول إليها أو حيازتها، وأن تُعمل هذا المبدأ إعمالاً تاماً، وذلك بالنظر إلى حق الشعوب الأصلية في تقرير مصيرها وحقها في الأراضي والأقاليم والموارد التي تمتلكها تقليدياً أو تمكنت بصورة أخرى من وضع اليد عليها واستغلالها؛

In that respect, the development of the notion of indigenous peoples, for example, was significant because it recognized, among other things, their right to their traditionally owned or occupied lands.
