22. This mode of application of the definition is to be commended precisely because it avoids treating the interposition of an armed conflict as having an automatic effect in relation to all the treaty relations of the States concerned.

28. Several delegations welcomed the inclusion within the scope of the draft articles (as established in draft article 1, Scope) of cases in which only one of the States parties to a treaty was a party to an armed conflict, as well as of the effects of an internal armed conflict on the treaty relations of the State concerned.

As already explained in paragraph (4) of the commentary to article 1, the treaty relations of international organizations are excluded from the scope of the present draft articles, and the concluding phrase cited above was included to forestall an interpretation of the scope which would have excluded multilateral treaties that include international organizations among their Parties.

260. It follows that a permissibly established reservation affects the treaty relations of the author of the reservation in that it excludes or modifies the legal effect of a provision or provisions of the treaty, or even of the treaty as a whole, on a specific aspect and on a reciprocal basis.

Accordingly, it supported the Special Rapporteur's proposal to include a saving clause reading " [t]he present draft articles are without prejudice to any rules of international law that regulate the treaty relations of international organizations in the context of armed conflict " .

In exceptional circumstances it might be possible for a party to rely upon an estoppel against a State which attempts to argue that its statement is a reservation. [...] While this is a matter of interpretation rather than the application of equitable principles, it is in keeping with notions of fairness and good faith which underlie the treaty relations of States. "
وقد يجوز لأحد الأطراف، في حالات استثنائية، أن يتمسك بقاعدة الإغلاق إزاء دولة تحاول الاحتجاج بأن بيانها يشكل تحفظاً. [...] ولئن كان ذلك ينطوي على تفسير أكثر مما ينطوي على تطبيق مبادئ الإنصاف فإنه يتماشى مع مفهومي الأمانة وصدق النية اللذين تقوم عليهما العلاقات التعاهدية بين الدول " ().

Accordingly, three scenarios would be contemplated: (a) the situation concerning the treaty relations between two States engaged in an armed conflict; (b) the situation of the treaty relations between a State engaged in an armed conflict with another State and a third State not party to that conflict; and (c), the situation of the effect of an internal armed conflict on the treaty relations of the State in question with third States.
