1. Communications may be submitted by or on behalf of an individual or group of individuals, within the jurisdiction of a State party, claiming to be victims of a violation by that State party of any of the rights set forth in:

The Committee recalled that article 1 of the Optional Protocol applies to individuals subject to the jurisdiction of the State concerned who claim to be victims of a violation by that State of their rights under the Covenant, regardless of their nationality.
وذكرت اللجنة بأن المادة ١ من البروتوكول الاختياري تنطبق على اﻷفراد الخاضعين للولاية القضائية للدولة المعنية الذين يدعون بأنهم ضحايا انتهاك تلك الدولة لحقوقهم المنصوص عليها في العهد، بصرف النظر عن جنسيتهم.

That protocol provides for the capacity of CEDAW to examine communications presented by individuals or groups subject to the jurisdiction of a State party, who consider themselves victims of a violation, by that State, of one of the rights stipulated in the Convention.
وينصّ هذا البروتوكول على إنشاء وتنظيم اختصاصات اللجنة المعنية بالقضاء على التمييز ضد المرأة للنظر في البلاغات التي يقدمها أشخاص أو مجموعات أشخاص يخضعون لولاية دولة طرف، ويؤكدون أنهم ضحايا انتهاك من جانب هذه الدولة الطرف للحقوق المنصوص عليها في الاتفاقية.

Article 1 of the Optional Protocol provides that a State party to the Optional Protocol " recognizes the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by that State party of any of the rights set forth in the Covenant " .
4- وتنصّ المادة 1 من البروتوكول الاختياري على أن تعترف كل دولة طرف فيه باختصاص اللجنة في أن تتلقى البلاغات المقدمة من الأفراد الخاضعين لولايتها الذين يدّعون أنهم ضحايا انتهاك تلك الدولة الطرف لأي حق من الحقوق المقررة في العهد وأن تنظر في تلك البلاغات.

4. Article 1 of the Optional Protocol provides that a State party to the Optional Protocol " recognizes the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by that State party of any of the rights set forth in the Covenant " .
4- وتنصّ المادة 1 من البروتوكول الاختياري على أن تعترف كل دولة طرف فيه باختصاص اللجنة في أن تتلقى البلاغات المقدمة من الأفراد الخاضعين لولايتها الذين يدّعون أنهم ضحايا انتهاك تلك الدولة الطرف لأي حق من الحقوق المقررة في العهد وأن تنظر في تلك البلاغات.

6.4 The Committee observed that pursuant to article 1 of the Optional Protocol, the Committee may only receive and consider communications from individuals subject to the jurisdiction of a State party to the Covenant and to the Optional Protocol " who claim to be victims of a violation by that State party of any of their rights set forth in the Covenant " .
٦-٤ لاحظت اللجنة أنه عملا بالمادة ١ من البروتوكول الاختياري لا يجوز للجنة سوى استلام ونظر الرسائل المقدمة من اﻷفراد الداخلين في ولاية دولة طرف في العهد والبروتوكول الاختياري " الذين يدعون أنهم وقعوا ضحايا انتهاك من جانب هذه الدولة ﻷي حق من حقوقهم المقررة في العهد " .

Having noted that the Democratic Republic of the Congo had not provided " the slightest piece of evidence " to corroborate its assertion that it had orally informed Mr. Diallo of his rights, the Court found that there had been a violation by that State of article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations.
